RESERVATION IN SERVICE MANUAL

The reservation rosters are not maintained properly by Govt Department . DOPT has not communicated any guide lines on the maintenance of reservation rosters. A manual prepared by Institute of Secretariat Training and management New Delhi has given the details of maintenance of reservation roster. If the reservation rosters is not maintained properly, the ultimate looser is SC/ST category employees . It is the responsibility of each employee who appointed on reservation to see that the rosters are correctly maintained by their dept . Like wise the SC/ST/OBC Association should keep a watch over the maintenance of the rosters and it should be periodically examined for each category of post.

In many Dept the recruiting units are not bothered to close the rosters every year to tally the requirement of 
SC/ST vacancies .if the rosters are not maintained properly vacancies vacated by SC/ST points are not filled up or carried forward ,. The author had seen in many offices in the gradation list against the names of muslim officials, community of the officials were noted as SC! since the rosters are prepared based on the gradation list and if it contains wrong information the roster also become wrong.


If the reservation roster is not maintained properly there is a possibility of counting the meritorious SC/ST employees who were appointed / promoted in merit as SC/ST category and treated as excess at the end of the year while closing the roster, resulting denial of rightful share of SC/ST in subsequent recruitment and promotion.

Similarly in every department SC/ST Association is functioning but unfortunately the office bearer of the association are failed to examine their own office rosters. Though the rosters are not secrete but no body wants to examine it . Now after the introduction of RTI act the Govt departments are expected to publish the rosters in their website as per section 4 of RTI act ( Pro active disclosure) but non of the Govt department is come forward to disclose the rosters in their website. Now the individual and association can have copies of roster through RTI act and see that it is maintained properly.

The SC/ST Liaison officer of the Govt department is expected to inspect the rosters but these officer seldom inspect the recruiting unit in their department . Now the individual and association will resort the RTI act to get the copy of the inspection report and information through RTI and ensure that these officer is regularly inspecting the office.

Govt. of West Bengal, ruled either by earlier party or by present party had/have least interest to follow the reservation roasters in services in favour of sc/st community and now the Department of Backward classes welfare department of Govt. of W.B are also in a mood to abolish the reservation policy by de-reserving the post of Anganwari workers and helpers via G.O.No.3019-BCW/MR-215/08,dated 15th September 2014, in the engagement of staff according to the policy in a central scheme of Anganwari under ICDS Projects in State and following the same technique such as non availabity of qualified (qualification require for that post is/are Madhyamik/Hihger Secondery) candidate of that reserve community as happened in year 2000-2001 for regularization of services of part-time/Ad-hoc nonqualified employee in various group of sanctioned post in various department of Govt. of W.B. Or it may be said that on the 68th year of independence of uor country ,State Gov. of West Bengal is not in a position to uplift or upgrade the status of reserve category in district level and overall State level educationally and economically up to Madhyamik/H.S in-spite having different scheme of centrally as well as State and which cannot be true according to census 2001.

  3. Subject: Right of Reservation for Employment for Scheduled Castes and Scheduled Tribes-in Govt. Services -Left to the mercy of State Govts. by the Judgement of Hon'ble Supreme Court of India(judgement dt.07/02/2020)-reg.




    Whither Reservations-To Whomsoever it may Concern!
    Reservation for Scheduled Castes and Scheduled Tribes was granted by founding fathers of constitution for historical reasons!

    The intention of the framers of constitution is, as a welfare state, to uplift the downtrodden members of our society who were suppressed and oppressed for many
    centuries for various factors well known to the people of India and the whole world!

    And by no stretch of imagination the framers of constitution intended to give it as a choice to the state governments in implementing the constitutional provision of Reservation for Scheduled Castes and Scheduled Tribes for employment in various posts and services under the govt..

    However, it is unfortunate that the constitutional provisions granted by founding fathers of constitution for historical reasons is being misinterpreted by various court of law including Hon'ble Supreme Court of India.

    Even in a recent judgement (Mukesh Kumar & Anr. Vs The State of Uthrakhand & Ors.-Civil Appeal No. 1226 of 2020, date of Judgement February 07 2020) the Hon'ble Supreme Court of India have reiterated that the rule of reservation granted by founding fathers of constitution for Scheduled Castes and Scheduled Tribes for employment under Govt.is not a right and is left to the state govt.which is against the intention and will of the founding fathers of constitution !
    And the Hon'ble judges went on to rule that " Even if the under representation of the Scheduled Castes and Scheduled Tribes in the public services is brought to the notice of this court(Supreme Court) , no mandamus can be issued by this court to the State Government to provide reservation"(Para 16); this may be Law but not Justice..

    It looks as though we, the unfortunate Scheduled Castes and Scheduled Tribes of this country is left to the mercy of state governments which we will never get.

    However, to rectify this error,
    1) it is in fitness of things that the constitution is amended and the Reservation policy is included in the IX Schedule of the Constitution of India;
    2)Th Govt. of India should issue suitable orders to all state/central/ Union Territory govts.to implement reservation rules for Scheduled Castes and Scheduled Tribes scrupulously without any backlog ,to fulfill the intention,the will and the vision of the constituent Assembly for uplifting the downtroddens!
