Dalits try to pull down ‘caste wall’ in cemetery

  A group of activists belonging to a fringe dalit outfit attempted to demolish a wall cutting through a Christian cemetery in Tiruchi on Friday, alleging that it was a sign of untouchability, dividing the space in the cemetery for dalits and non-dalits. The activists of Tamil Nadu Oppressed People Liberation Movement barged into the RCMC Cemetery at Melaputhur in the heart of the city and began demolishing the wall with iron rods and hammers. Members of the RCMC Cemetery Protection Society informed the police who rushed to the spot and arrested eight of the activists who were trying to pull down the wall.
    Nilavazhagan, secretary of the front, said their action was not intended to hurt anyone. “We wanted to remove the wall that remained as a sign of untouchability. The wall should be removed by the authorities immediately,” he said. “Christians of 32 residential areas in Tiruchi have been using the cemetery for around two centuries. The 800-feet wall cutting
through the cemetery divides the space for dalits and non-dalits. Dalits were not allowed entry into the space demarcated for non-dalits,” he alleged.
    Nilavazhagan and his men had managed to knock off a few bricks of the wall in some places, though the structure remained intact.
    In 1976, the wall was partially razed down by a similar group led by a priest. But later the wall was built again after the cemetery protection committee obtained a court order in their favour. A few days back,
the Periyar Dravidar Kazhagam led by its president Kolathur Mani along with 1,200 persons staged a protest in Tiruchi demanding that the wall be demolished. Condemning the presence of the wall in the cemetery, Mani alleged that it was a sore symbol of untouchability.
    However, the RCMC Cemetery Protection Society, formed years back when first signs of opposition to the wall emerged, justified the presence of the structure saying that the purpose of the wall was protection.

காந்தி - தீண்டாமையின் நவீன வடிவம்

‘மகாத்மா காந்தி' என்ற மோகன்தாஸ் கரம்சந்த் காந்தி எனக்குள் பிரவேசிக்கத் தொடங்கியது, அநேகமாக எனது 5 ஆவது வயதில் எனக்கணக்கிட்டுப் பார்க்கிறேன். அது என் தொடக்க கல்விக்காகப் பள்ளிக்குச் சென்ற வயது. நகராட்சிப் பள்ளியாக இருந்தபோதும், ஒவ்வொரு வாரமும் வெள்ளிக்கிழமை காலை காந்தியின் பஜனைப் பாடல்களைப் பாட வேண்டும். ஒரு மணி அடிப்பார்கள், 1ஆம் வகுப்பு முதல் 5ஆம் வகுப்பு வரை உள்ள அனைத்து மாணவர்களும் தரையில் சப்பணமிட்டு அமர்ந்தபடி, இரண்டு கைகளையும் கும்பிட்டபடி, தலை தரையைத் தொடும்படி உட்கார்ந்து கொண்டு, "ரகுபதி ராகவ ராஜாராம்' தொடங்கி, ஏறத்தாழ அரைமணி நேரத்திற்கு காந்தியின் பாடல்களைப் பாடுவோம். நான் படித்த நகராட்சிப் பள்ளி இருந்த பகுதியும் காந்தி நகர். தலைமை ஆசிரியரின் நாற்காலிக்குப் பின்புறச் சுவரில் மாட்டப்பட்டிருக்கும் படத்திற்குரியவராகவும், பஜனை செய்வதற்குரியவராகவும், பாடப் புத்தகங்களில் படிப்பதற்குரியவராகவும், சுதந்திர நாள், குடியரசு நாள், அவர் பிறந்த நாள் போன்ற நாட்களில் வகுப்புகள் தொடங்குவதற்கு முன் மைதானத்தில் நடக்கும் இறைவணக்கக் கூட்டமாக இருந்தாலும், அனைத்திலும் பேசப்பட்ட, பேச வைக்கப்பட்ட ஒருவர் காந்திதான். பிறகுதான் நேரு மாமா!




காந்தி தாத்தாவாகவும், நேரு மாமாவாகவும் என்னுள் கருத்துருவாக்கப்பட்டதுதான் இதற்கான மூலகாரணமாக இருக்க வேண்டும். ஏனெனில், இந்த பாதிப்புகள் எனக்குள் மட்டும் அல்ல; ஏறத்தாழ என் வயது, அதற்கு மேலும் உள்ள வயதினருக்கும் கூட இதுதான் நிலைமை. இது, உள்வாங்கிக் கொள்ளப்பட்டது அல்ல, உள்ளே திணிக்கப்பட்டது. இன்றைக்கும் கூட, இதுதான் இந்தியத் திணிப்பாக இருக்கிறது. இந்தியாவில் வேறு எந்தத் தலைவரையும் இந்த அளவிற்கு திட்டமிட்டுத் திணிக்கவில்லை!



1960 களில் தொடங்கி 1974 வரை, தொடக்கக் கல்வி முதல் மருத்துவக் கல்லூரி மாணவனான பிறகும் கூட, பாபாசாகேப் டாக்டர் அம்பேத்கர் என்ற ஒருவர் என்னுள் வரவேயில்லை. ஏப்ரல் 14, 1975ஆம் ஆண்டு சகோதரர் கே.ஆர்.எம். ஆதிதிராவிடர் அவர்கள் என்னையும், டாக்டர் ஜெயவேல் அவர்களையும் அழைத்துக் கொண்டு, சென்னை நேரு உள் விளையாட்டரங்கத்திற்கு வெளியே நின்ற அம்பேத்கர் சிலைக்கு மாலையணிவிக்கச் செய்தார். இடஒதுக்கீட்டில் இடம் பெற்று, சென்னை மருத்துவக் கல்லூரியில் படிக்கத் தொடங்குவதற்கு முன்பு வரை, எத்தனையோ முறை விண்ணப்பப் படிவங்களில் 18 சதவிகித இடஒதுக்கீட்டில் இடம் பெற விண்ணப்பித்திருக்கிறேன். இடம் பெற்றேன். ஆனால் அதுவரை கூட, இந்த இடஒதுக்கீடு கிடைக்க, இந்திய அரசமைப்புச் சட்டத்தில் இதற்கான சட்டத்தை எனக்கும், என் சமூகத்திற்கும் பெற்றுக் கொடுத்த இந்த மாபெரும் புரட்சியாளரைப் பற்றி அறியாதிருந்தேன். என்னைப் போலவே, அன்றும் இன்றும் கோடிக்கணக்கான தலித்துகள் இருக்கிறார்கள்.



டாக்டர் அம்பேத்கர், ஜோதிபா புலே, அயோத்தி தாசப் பண்டிதர், தாத்தா ரெட்டமலை சீனிவாசன் போன்றவர்களின் நூல்களைப் படித்த போதும், சுபாஷ் சந்திர போஸ், பகத் சிங், உத்தம் சிங் மற்றும் இந்திய சுதந்திரப் போராட்ட வரலாறுகளாலும், தந்தை பெரியார் காந்தியுடன் முரண்படும் இடங்களாலும், காந்தி மீது நான் அன்று கொண்டிருந்த எண்ணங்கள் கொஞ்சம் கொஞ்சமாக சரியத் தொடங்கின. ஜவகர்லால் நேரு, எம்.ஓ.மத்தாய் மற்றும் ஊணூஞுஞுஞீணிட் ச்t Mடிஞீணடிஞ்டt எழுதிய லேப்பியர் மற்றும் காலின்ஸ் போன்றவர்களின் கருத்துகளும் மாறுபட்டிருந்தன.



1934 இல் வியன்னாவில் இருந்து, சுபாஷ் சந்திர போஸ் எழுதி இந்தியாவில் தடை செய்யப்பட்ட நூலான "இந்தியப் போர்' என்ற நூலைப் படித்தபோதுதான், காந்தியின் சுதந்திரப் போராட்டமே கேள்விக்குரியதாக இருந்தது. காந்தியைப் பற்றி குறிப்பிடும்போது, “இந்தியர்களை ஈர்க்கும் ஓர் அபூர்வ சக்தி காந்தியிடமிருக்கிறது. பிறிதொரு நாட்டில் அவர் பிறந்திருந்தால், அந்நாட்டில் அவர் முற்றுந் தகுதியற்றவராகவே இருந்திருப்பார். அங்கு அவரது சாத்வீகம், அவருக்கு ஆபத்துண்டாக்கியிருக்கும் அல்லது பைத்தியக்கார ஆஸ்பத்திரிக்கு அனுப்பியிருக்கும். ஆனால், அது இந்தியாவில் வேறுவிதம்...” ("இந்தியப் போர்', பக்கம் : 169).



இறந்து 59 ஆண்டுகள் முடிந்த பிறகும் கூட, எதற்காக அவர் விவாதிக்கப்பட வேண்டும்? ஒரு சிறு பிரிவு மக்களைத் தவிர, இந்தியாவின் அனைத்துப் பிரிவு மக்களும் காந்தி என்ற பெயரை புனிதமானதாக எண்ணிப் போற்றிக் கொண்டிருக்கின்றனர்.



அண்மையில் "தீராநதி' இதழில் (ஆகஸ்ட் 2009) வந்த ஒரு செய்தி என்னை அதிர வைத்ததும் கூட, இந்த வெளீயிட்டைக் கொண்டு வரக் காரணமாயிருந்தது. அதாவது, "யுனெஸ்கோ' நிறுவனம், 1947 இல் வெளியிட்டிருக்கும் "கல்வி குறித்த சிந்தனையாளர்கள்' புத்தகத் தொகுப்பில், உலகின் பெரும் புகழ் பெற்ற சிறந்த கல்வியாளர்கள் நூறு பேருடைய அர்ப்பணிப்புகள் பற்றி விவாதிக்கப்பட்டுள்ளது. சீனாவின் கன்பூசியஸ், கிரேக்கத்தின் பிளாட்டோ, ஆஸ்திரியாவின் பிராய்டு, இத்தாலியின் கிராம்ஸி போன்றவர்களோடு இந்தியாவின் பிரதிநிதியாக இந்தப் புத்தகத்தில் இடம் பெற்றிருப்பவர்கள், காந்தி, தாகூர், அரபிந்தர், ஜே.கிருஷ்ணமூர்த்தி மற்றும் டாக்டர் மால்கம் ஆதிசேஷையா.



டாக்டர் மால்கம் ஆதி சேஷையா, தாகூர் தவிர மற்ற மூவருக்கும் கல்விக்கும் என்ன தொடர்பு? மற்ற மூவரும் ஆன்மிகவாதிகள். பிளாட்டோ, பிராய்டு வரிசையில் வருமளவிற்கு காந்தி கல்வியாளரா? இந்தியாவில் கல்வியாளர்களுக்கு இவ்வளவு கடும் வறட்சியா? அல்லது கன்பூசியஸ், கிராம்ஸி அளவிற்கு காந்தி கல்விச் சிந்தனையாளரா?



ஆதிக்க சாதியினரைத் தவிர, மற்ற தீண்டத்தகாதவர்கள் (அன்று 6 கோடி) கல்வி கற்பதற்குத் தடையாயிருந்த தத்துவம் வர்ணம். வர்ணம்தான் அனைத்து இழிவுகளுக்கும், வன்கொடுமைக்கும் காரணமாயிருந்தது. இருக்கிறது. வர்ணம் ஒழியாத வரை தீண்டாமை ஒழியாது. அந்த வர்ணம் குறித்த காந்தியின் செயல்திட்டம் என்ன? வர்ணத்தை ஒழித்து, அனைவருக்கும் கல்வி கிடைக்க காந்தி என்ன செய்தார்? சிறீமான் காந்தி வர்ணத்தைப் போற்றிப் பாதுகாக்கிறார். எப்படி? "வர்ணம் விதித்ததுதான் நியதி. அது மாற்றமில்லாதது. வர்ண விதியை நாம் பின்பற்றி நடக்காததுதான், பொருளாதார அழிவுக்குக் காரணமாக உள் ளது. மக்களின் வேலையில்லா திண்டாட்டத்திற்கும் வறுமைக்கும் அது காரணமாயிருக்கிறது' என்று எச்சரிக்கிறார்.



வர்ணம் ஒரு மனிதருக்கு - என்ன தொழிலை விதித்துள்ளதோ அந்தத் தொழிலைத்தான் அவர் எடுத்துக் கொள்ள வேண்டும். நூறு ஆண்டுகளுக்கு முன் ஒரு மரத் தச்சரின் மகன், தான் ஒரு வக்கீலாக வேண்டும் என்று ஒருபோதும் விரும்பியதில்லை. ஆனால், இன்று ஒரு தச்சனின் மகன் வக்கீலாக வேண்டும் என்று விரும்புகிறார். ஏனெனில் பணம் திருடுவதற்கு, அந்தத் தொழில்தான் மிக எளிதான வழி என்பதை அவர் அறிந்து கொண்டிருக்கிறார் (மகாத்மா காந்தி நூல்கள் தொகுப்பு - 7, பக்கம் 89, 90, 91).



மருத்துவனாக மாற விரும்பினால், அவனைத் திருடன் என்கிறார்! பொருளாதாரத்தில் பின் தங்கிய ஒரு தேசத்தைக் கல்வி தானே சீர்படுத்தும். லெனின் ஆட்சியதிகாரத்திற்கு வந்தபோது, சோவியத் ரஷ்யாவில் படித்தவர்கள் எண்ணிக்கை 2 சதவிகிதம். தோழர் அந்தன் மொகரங்கோவிடம், கல்வி பயிற்றுவிக்கும் பொறுப்பினைக் கொடுத்தபோது, லெனின் கேட்டுக்கொண்டது ஒன்றே ஒன்றுதான். "ரஷ்யாவில் உள்ள மக்கள் நூறு சதவிகிதம் கல்வி கற்றவர்களாக மாற்றப்பட வேண்டும்' என்பதுதான். பத்தே ஆண்டுகளில் 2 சதவிகிதமாக இருந்த படித்தவர்களின் எண்ணிக்கையை 98 சதவிகிதமாக மாற்றிக் காண்பித்தாரே! லெனின் கல்வியாளர். ஆனால் காந்தியோ குலத் தொழிலை விட்டுவிட்டால் பொருளாதாரம் சீர்குலைந்துவிடும் என்கிறார்!



இவரைப் போய் உலகில் தோன்றிய கல்வியாளர்கள் பட்டியலில் இடம்பெயரச் செய்துள்ளனரே! ராஜாகோபாலாச்சாரியின் குலக்கல்வித் திட்டத்திற்கு காந்திதான் குரு. குலக் கல்வித் திட்டம்தான் இந்தியாவை சமூக, பொருளாதார அழிவிலிருந்து காப்பாற்றும் என்றும் கூறுபவர் கல்விமானா? காந்தியின் "அரசியல்' பற்றிய விமர்சனங்கள், அவர் அரசியல் நடத்திக் கொண்டிருந்த காலத்திலேயே, பகத்சிங் மரணத்தில் "வஞ்சக நாடகமாடியது' தொடர்பாக வந்த விமர்சனங்களே இன்று வரைக்கும் ஆவணமாக உள்ளது. அதற்குள் போகத் தேவையில்லை.



பொருளாதாரம் குறித்த அவரது பார்வையில், அவர் காலத்தில் வாழ்ந்த 35 கோடி இந்தியர்களுக்குமான எந்த செயல்திட்டமும் இல்லை. 35 கோடி 110 கோடியாக உயர்ந்தால் என்ன செய்ய வேண்டும் என்று கூறுமளவிற்கு, அவரிடம் பொருளாதார ஞானமும், பொருளாதாரம் குறித்த அடிப்படைச் சிந்தனையும் இல்லை. தொலை நோக்கு அறிவும் இல்லை. அடுத்ததாக "இந்தியாவின் தொழு நோயான' தீண்டாமையைப் போக்குவதற்குப் பதிலாக, சாதியக் கொடுங்கோன்மையைத் தூக்கிப் பிடித்த காந்தியின் கோர முகத்திரையை அம்பேத்கர் - "காந்தியும், காங்கிரசும் தீண்டத்தகாத மக்களுக்குச் செய்தது என்ன?' என்ற நூலில் கிழித்துக் காண்பித்துள்ளார்.



இன்னமும் கூட, இந்தியாவில் தலித் மக்கள் வாழ்கின்ற பெரும்பான்மைக் குடியிருப்புப் பகுதிகளுக்குப் பெயர் "காந்தி நகர்!' இது அவமானப் பெயர் அல்லவா? எம் மக்களின் அறியாமையைப் பயன்படுத்திக் கொண்டு எழுப்பப்பட்ட பெயரல்லவா? டாக்டர் அம்பேத் கரும் தந்தை பெரியாரும் மறைந்து இத்தனை ஆண்டுகள் ஆன பின்பும் கூட, பார்ப்பனியத்திற்கு அவர்கள் மாபெரும் அச்சுறுத்தலாக இருப்பதைப் போலவே, தீண்டத்தகாத மக்களாக்கப்பட்ட தலித்துகளுக்கு, காந்தியின் தலித் விரோத, நால்வர்ணச் சிந்தனைகள் இன்னும் கூட ஓர் அச்சுறுத்தலாகவே இருந்து வருகின்றன.



“என் அபிப்ராயத்தில் பரம்பரையாய் அல்லது சுயமாய் அடைந்த உயர்நிலை என்பதே இல்லை. எல்லோரும் பிறக்கையில் சமமாகவே பிறக்கின்றனர். பிறப்பினாலேயே பின் அடைந்த ஞானத்தினாலோ பிராமணர் தங்களை மேல்சாதியார் என அழைத்துக் கொள்ளும் இடங்களிலெல்லாம் நான் அவர்களை எதிர்த்திருக்கிறேன். இன்னொரு மனிதனை விடத் தான் உயர்ந்தவனாகக் கருதுவது மனிதத்தன்மையற்ற செயல் என்பது என் கருத்து... ஆகையால் பிராமணனிடமோ, வேறு எவரிடமோ இந்த உயர்சாதிப் பேய் தலைகாட்டுவதை பிராமணன் அல்லாதான் எதிர்க்கையில் அவனுக்கு நான் உறுதுணையாய் நிற்கிறேன். உயர்ந்தவனென்று தன்னை கருதுவோன், தான் மனிதனாய்க் கருதப்படுவதற்குள்ள உரிமையை இழந்து விடுகிறான் என்பது என் அபிப்ராயம்” ("யங் இந்தியா' 29.9.1927).



லோகமான்ய திலகரின் இறுதி ஊர்வலத்தில் கலந்துகொள்ள 1.8.1920 அன்று காந்தி அங்கு சென்றார். திலகரின் பாடையைத் தூக்குவதற்கு தோள் கொடுக்க காந்தி சென்றபோது, அங்கிருந்த பார்ப்பனர்கள், “நீ வைசியன், இந்தப் பாடையைத் தொடக்கூடாது” எனக் கூறி அவரைப் பிடித்துக் கீழே தள்ளினார்கள். (தனஞ்செய் கீர் எழுதிய "லோகமான்ய திலகர்' - ஆங்கில நூல் பக்கம். 442). நால் வர்ணக் கட்டமைப்பில் மூன்றாவது இடத்தில் இருப்பவர்க்கே இதுதான் மரியாதை! பிணத்தைத் தொடுவதற்குக் கூட அருகதையற்றவராகத்தான் காந்தி பார்ப்பனர்கள் கண்களுக்குப் பட்டாரே தவிர, இந்திய தேசத்தின் விடுதலையை முன்னிறுத்துபவராகத் தெரியவில்லை. இதுதான் இந்து மதம். இதற்குப் பிறகும்கூட "வர்ணத்திற்கு' இவர் பொழிப்புரை எழுதுவது, இந்து மதம் பற்றிய அடிப்படை அறிவு அறவே கிடையாது என்பதைத் தவிர வேறு ஏதும் இல்லை!



"தீண்டாமை, இரக்கமற்ற செயல்' என்பதைச் சொல்ல "மகாத்மா' தேவையில்லை. ஒன்றாம் வகுப்பு படிக்கும் என் தெருக்குழந்தை கூட, தீண்டாமையின் கொடுமையைப் பார்த்துக் காறித் துப்பும். இவர் என்ன இரக்கப்படுவது? இவரின் இரக்கம், வெண்மணியில் வெந்த எம் குழந்தைகளின் மயிருக்குக் கூட உதவாது. தீண்டாமையின் இழிவினை, அவமானத்தை 24 மணிநேரமும் நேருக்கு நேர் எதிர் கொள்பவனுக்குதான் அதன் வேதனை என்னவென்று உணர முடியும்!



அடுத்ததாக இவர் சொல்கிறார் : “உயர் சாதிப் பேய் தலைகாட்டுவதை பிராமணன் அல்லாதவன் எதிர்க்கையில், அவனுக்கு நான் உறுதுணையாய் நிற்கிறேன்”.... தெற்கே, மாபெரும் இயக்கப் போராளி தந்தை பெரியார் பார்ப்பனர்களை நேருக்கு நேர் எதிர்த்தபோது, இவரும் இவரோடு குல்லாப் போட்டுக் கொண்டிருந்த கூட்டமும் எத்தனை முறை பெரியாரோடு இணைந்து, பார்ப்பன ஆதிக்கத்தை எதிர்த்தனர் என்பதற்கு ஆதாரம் இருக்கிறதா? அல்லது பெரியாரைப் பற்றியும் அவருடைய இயக்கம் தமிழ் நாட்டில் நடத்திய போராட்டங்களும் இவருக்குத் தெரியாமல் போய்விட்டதா?



டாக்டர் அம்பேத்கரோடு இவரும், இவரது காங்கிரஸ் கூடாரமும் எத்தனை பார்ப்பன எதிர்ப்பு இயக்கங்களை நடத்தின? அப்போதெல்லாம் இவர் எங்கே போயிருந்தார்? எத்தனைப் போராட்டங்களை இவரே முன்நின்று நடத்தினார்? இதற்கு ஏதேனும் ஆதாரப்பூர்வமான சான்றுகள் உண்டா? ஒரு "மகாத்மா' பேசியதற்கும் அது செயல்பட்டதற்கும், ஏதேனும் தொடர்பு உண்டா?



அன்றைய தேதியில் 35 கோடி மக்கள் தொகையும், மிகப்பெரிய நிலப்பரப்பும் கொண்ட தேசம் அன்னியராட்சியில் சுரண்டப்பட்டு வந்த காலத்தில் (அவர்கள் சுரண்டுவதற்காகவே, பல திட்டங்கள் தீட்டினாலும்) மக்களின் அடிப்படைத் தேவையான போக்குவரத்திற்கு ரயில்களும், ஆரோக்கியத்திற்கு மருத்துவமனைகளையும் கட்டி வந்ததையும் இந்த தேசத்திற்குச் சுதந்திரம் வேண்டும் என்று தலைமையேற்று நடத்திவந்த "சுதந்திரப் போராட்ட வீரர்' கூறுகிறார்...

இதுபோன்ற "அறிவார்ந்த' கருத்துகளைக் கூறி வந்த சிந்தனைக் கடலின் ஒப்பற்ற அறிக்கைகளை, அவருடைய துதிபாடிகள் வேண்டுமானால் பெருமைப்பட்டுக் கொள்ளலாம். ஆனால் இவரின் "கருத்துகளும்' "செயல்பாடுகளும்' தான்தாழ்த்தப்பட்ட மக்களின் தீண்டாமையை வேரோடும் வேரடி மண்ணோடும் "பிடுங்கி எறிந்தது' என்ற வரலாற்றுப் பொய்யை நாம் எப்படிச் சகித்துக் கொள்ள முடியும்?



காந்தி, தாழ்த்தப்பட்ட மக்களுக்காக ஏன் போராடவில்லை? என்று எந்த தலித்தும் எந்தக் காலத்திலும் கேள்வி எழுப்பியது இல்லை. அது தேவையும் இல்லை. எம் மக்களின் பிரச்சனைகளுக்குப் போராட எமக்கென்று தலைமை இருக்கிறது. எமது விடுதலைக்காகப் போராடிய எமது ஒப்பற்ற தலைவர்களின் பணிகளை, எம் மக்களின் அறியாமையைப் பயன்படுத்தி, அவர்களிடம் எம் தலைவர்களைப் பற்றிய தவறான புரிதல்களை ஏற்கச் செய்த சாகசங்கள் எல்லாம் வழிநெடுக ஏராளமாகப் பரவிக் கிடக்கின்றன.



பவுத்தம் கோலோச்சிய காலங்களில் இவர்களின் சமூக, பொருளாதார, அரசியல் தர்க்க நிலைகள் வெகுவாகச் சிறப்புற்றிருந்தன என்பதற்கான ஆதாரங்கள் செழுமையாக உள்ளன. பூர்வ பவுத்தர்களான இவர்கள் பார்ப்பனியத்தால் சிதறடிக்கப்பட்டு, திருநிலையற்றவர்களாக, ஊருக்கு ஒதுக்குப்புறமான சேரிகளில் வாழ நிர்பந்திக்கப்பட்டனர். பார்ப்பனியம் வெற்றி பெற்று, இவர்கள் இந்துக்களாக்கப்பட்டனர். மீண்டும் நால்வர்ணப் படிநிலை சமூகம் வந்த பின்பு, இவர்கள் இந்து மதத்தின் பின் இணைப்பாகக் கருதப்படுகின்ற பஞ்சமர்கள் என்ற வர்க்கமாக்கப்பட்டார்கள். அதன் பின்னர் தொடர்ந்து இம்மக்கள் வஞ்சிக்கப்பட்டே வந்தனர்.



1891 ஏப்ரல் 14 அன்று மகாராட்டிரத்தில் தாழ்த்தப்பட்ட வகுப்பில் பிறந்த அம்பேத்கர், 19 ஆம் நூற்றாண்டின் இறுதிப் பகுதியில் தாழ்த்தப்பட்ட மக்களின் அரசியல், சமூக, பொருளாதார விடியலுக்காகத் தன்னை அர்ப்பணித்தார். ஏறத்தாழ 2000 ஆண்டுகளாகத் திட்டமிட்டு ஒடுக்கப்பட்டு வந்த ஒரு சமூகத்தின் விடியலுக்கு, நிரந்தரத் தீர்வை ஆங்கிலேயர்களிடம் போராடிப் பெற்றார். "என் சமூகத்திற்கு விடுதலை கிடைக்க வேண்டும்' என்று உழைத்த அந்தப் புரட்சியாளரின் கனவை, காந்தி என்ற இந்து மத வெறியர் தன் நயவஞ்சகப் போராட்டத்தினால் கிடைக்கவிடாமல் தடுத்தார்.



ஆனால், இன்று தாழ்த்தப்பட்ட மக்களின் உயர்விற்காக குள்ளநரி ஒன்று போராடியதாகவும், தாழ்த்தப்பட்ட மக்களின் விடியலுக்காக அது உழைத்ததாகவும் இந்திய வரலாறு தலைகீழாக மாற்றித் தவறாக எழுதப்பட்டுள்ளது. அப்படி எழுதப்பட்ட வரலாற்றை உலக மக்களுக்கு இன்றுவரை அது போதித்து வருகிறது. இம்மக்களின் அறியாமையைப் பயன்படுத்தி, இந்து மதமும், இந்து சனாதனிகளான பார்ப்பனிய - பனியா கும்பல்களும், இந்த மக்களை காந்தியின் விசுவாசிகளாகவும் மாற்றியுள்ளனர்.



இந்து வெறியரான, தலித்தின மக்களின் நயவஞ்சக துரோகியான காந்தி என்பவர், இம்மக்களின் "ஆபத்பாந்தவர் அல்லர்' என்ற வரலாற்று உண்மைகளை காந்தி வாழ்ந்த காலத்திலேயே அம்பலப்படுத்தினார் அம்பேத்கர். இந்தப் பசுத்தோல் போர்த்திய புலி எவ்வாறு தலித் விரோதப் போக்கை தலித் மக்கள் மீது கட்டவிழ்த்துவிட்டது என்பதை அனைத்து மக்களிடமும் ஆய்வுக்குக் கொண்டு செல்லும் நோக் குடனேயே "காந்தியின் தீண்டாமை' என்ற இத்தலைப்பு அமைக்கப்பட்டுள்ளது. இது பற்றி ஒரு திறந்த வாசிப்புக்கும், பொது விவாதத்திற்கும் உங்களை அழைக்கிறேன். நா.ஜெயராமன்

Hike grant under Kalaignar Housing Scheme, says Jayalalithaa
AIADMK general secretary Jayalalithaa on Tuesday urged Chief Minister M. Karunanidhi to take steps to bring down prices of construction materials, besides making a strong case for increasing the grant given under Kalaignar Housing Scheme.

“At a time the cost of construction materials has doubled, the grant of Rs.75,000 is not adequate. It should be increased to Rs.3 lakh,” she said in a statement.
The price of cement had increased to Rs.330 a bag from Rs.150 while that of two units of sand had gone up to Rs.6,500 from Rs.4,500. The price of a load of bricks had increased to Rs. 27,500 from Rs.16,000. “The ordinary and poor people, who have already started construction, are groping in the dark because of the sudden increase in prices of construction materials.”

She alleged that beneficiaries of the scheme were under pressure from the ruling party workers to hand over construction works to builders close to them.

Jaya seeks more funds for free housing scheme

Criticising the DMK government for failing to contain the steep hike in prices of construction materials, AIADMK general secretary J Jayalalithaa on Tuesday urged the administration to increase the subsidy under free housing scheme for the poor to Rs three lakh. In a statement, she alleged that the DMK government was remaining a passive spectator when the prices of cement, steel, bricks and sands were skyrocketing, shattering the dreams of the middle class people of owning a house.

The rising prices of cement and steel in the open market will not affect beneficiaries of the Kalaignar Housing Scheme, Chief Minister M. Karunanidhi said on Tuesday.

Pointing out that the scheme was being implemented in all 12,618 village panchayats simultaneously with each dwelling unit of 207 sq. ft, Mr. Karunanidhi, in a statement, said that the government was providing cement and steel at nominal cost to the beneficiaries through village panchayats.
Sixty bags of cement at Rs.210 a bag were being given. Steel — 155 kg for each house — was being supplied at an average rate of Rs.36 a kg.

Besides, District Collectors were taking steps for the supply of bricks at a reasonable rate by holding negotiations with owners of brick kilns. Efforts were on to provide other construction materials, including sand at rates determined by the government or less than market rate.

Training was being given to construction workers and financial assistance to women self-help groups through the Tamil Nadu Corporation for the Development of Women.

Deputy Chief Minister M.K. Stalin, who conducted a recent trip to the Tiruvannamalai district, informed him that two lakh houses would be completed by December-end and the entire number of three lakh houses by January, the Chief Minister said, giving an account of various welfare measures taken by him over the years in the area of low cost housing for vulnerable sections of society.

Dalit panchayat presidents in state tell tale of caste bias

"What are we having this liberty for? We are having this liberty in order to reform our social system, which is full of inequality, discrimination and other things, which conflict with our fundamental rights".

The routine duties of Thenmozhi Sekaran, dalit president of Karupur panchayat in Cuddalore district, do not just include the challenges of administering a village. He also has to frequently attend court and enquiries in connection with a case, which he claims has been foisted on him. But then, the panchayat presidency has been an uphill task for him all along, right from garnering votes to holding onto his post.


“It’s been a dirty fight all along,” he told TOI at a convention on dalit issues held in the city on Saturday. “After I occupied the office, we began construction of a link road from the village to the highway. But non-dalit members filed a case against me stating that the road passed through their private property. However, it was well known in the village that the property in question is poromboke land.”

The harassment meted out to Sekaran is not an isolated case. Today, in Tamil Nadu, despite years of welfare schemes and reservations for the dalits, both by the central and state governments, the situation remains largely unchanged. Says N Thalayan of the Dalit Panchayat Presidents’ Federation, “In many villages, dalit presidents are still not allowed to sit on chairs during panchayat meetings. The harassment meted out to women is more. I’ve known of women dalit presidents who were driven out of the village. They now reside in another village and visit their own village for purposes of administration.”


A good portion of the blame was apportioned to the government for improperly implementing the schemes. Says Vasanthi Devi, former chairperson of Tamil Nadu State Women’s Commission, “Very little of the funds meant for dalit welfare each year actually reaches them. The rest of the money is later channelled to other departments and schemes.”

Corroborating their claims, P Sampath, CPM state secretariat member later told TOI, “The government is only a silent spectator. Since 70-80% of the population comprises of non-dalits, successive governments prefer to defend the caste system in order to keep their vote banks happy.”

It does not seem so long ago that caste prejudice prevented elections to four reserved panchayats in Tamil Nadu for a decade until 2006. “Now that there are a few dalits who have become officials or hold key posts in the government, they (casteists) hesitate to directly attack us,” said Janaki Stalin, the panchayat president of Senji in Villupuram district. “Instead they’ve resorted to other means like piling up false cases against dalit presidents or creating internal strife among the dalits.”

Thirumavalavan attacks Congress, wants it out of DMK-led alliance

After vitriolic attacks by Congress leader E V K S Elangovan against the DMK, it is now the turn of VCK leader and Lok Sabha MP Thol Thirumavalavan, considered the dalit face of the DMK alliance, to launch criticisms against Congress.


Though this is not the first time Thirumavalavan has taken such a stand, considering his strong pro-LTTE leanings, the vehement criticism, at a time when parties are bent on crystallizing and strengthening alliances in the run up to the elections, it has provided fodder to speculations again that all is not well in the DMKCongress alliance.

In a recent interview to a Tamil magazine, Thirumavalavan said the Congress was a “blot” on the DMK alliance and a “liability”. “The DMK should not hesitate to snap ties with the Congress,” he said. Thirumavalavan had made scathing attacks on the Congress and the UPA government during the peak of war in Sri Lanka and the subsequent defeat of the LTTE. The latest provocation for his strong anti-Congress remarks was the participation of the Sri Lankan president Mahinda Rajapaksa in the valedictory ceremony of the Commonwealth Games in New Delhi. “What is the motive of the Congress government to invite Rajapaksa at a time when he is facing charges of war crime?’’ he questioned.

Thirumavalavan’s outburst has sparked a war of words with Karti Chidambaram, home minister P Chidambaram’s son, who has demanded the VCK’s leader’s resignation as MP. Karti demanded that Thirumavalavan, “who won as an MP with the support of Congress” should resign and face the people. Thirumavalavan’s reported statement faulting Rahul Gandhi for not calling on DMK patriarch M Karunanidhi during his visits to Chennai has also irked the Congress camp.

However, in a swift reaction, Thirumavalavan said there was no need for him to resign as it was the Congress which benefited from the Dalit vote bank in Tamil Nadu.

EVKS Elangovan, the firebrand critic of the state Congress party, dismissed Thirumavalavan as an insignificant factor in the Tamil Nadu political arena, but said his statements “did not appear” to be his own. Elangovan said, “He has aired the views of someone else (referring to the DMK leadership).”

The plight of Dalits and the news media

The new chairman of the National Commission for Scheduled Castes (NCSC), P.J. Punia, has begun his tenure by making a spirited appeal to the Central government to provide job reservation for Dalits in the private sector. He did not agree that reservation in private sector was a “misnomer.” He argued that the “private sector depends on the government, nationalised banks and state-owned financial institutions for its survival and thus cannot insulate itself from reservation.” Besides, he contended during a recent meeting with journalists in Hyderabad that the private sector also had a “social responsibility” to uplift the weaker sections of the people.
The next item on the NCSC chief's agenda is to streamline the implementation of the Scheduled Castes Sub-Plan (earlier known as the “Special Component Plan for Scheduled Castes”) in respect of budget allocations and put an end to the diversion of funds allotted to the plan. The Commission has prioritised its tasks: ensuring reservation for Dalits in the private sector and maximising the benefits of sub plans to Dalits.
Major concern It is not surprising that in a country in which a substantial section of the people, accounting for one-fifth of the population and segregated for centuries, remain poor, ill-treated, humiliated, and discriminated against, state intervention is the only antidote even after six decades of democratic governance under a republican Constitution. A major concern for the state is how to address the alarmingly rising unemployment among this section of society.
The Constitution provided for reservation in education and government employment for the Scheduled Castes and the Scheduled Tribes in proportion to their share in the population. This provision was made as part of the social strategy of affirmative action (or positive discrimination) to offset extreme historical discrimination and social oppression. If reservation, despite its existence for over 60 years, has failed to improve the lot of Dalits, the fault is to be seen not in the reservation system, but in the tardy way it has been implemented by the state. Disturbingly, there has been no concerted effort to take quality education to this section of the people.
The state's failure in this respect along with a flawed reservation system restricted to the entry point only helped ‘ caste-Hindu' bureaucrats to fill most of the higher posts on the ground that “qualified, eligible and fit” persons were not available among the Dalit claimants. Yet, if the establishment claims that Dalits have been appointed in government service in greater proportion than their share in population, it is because vacancies at the lowest levels are filled with Dalits, because, perhaps, no one else might be willing to offer himself for such jobs. It is surely a scandal that despite developments in technology, and in violation of a Supreme Court order, the central and State governments have failed to bring to an end the practice of manual scavenging and to rehabilitate those engaged in it in decent alternative employment.
While reservation has benefitted Dalits in general, it has not done much to elevate the majority of them to any higher position in society, mostly because of the state's failure on other fronts such as education and public health. And it must be remembered that a considerable number of these people remain outside this safety net. Over 70 per cent of Dalits live in villages and are dependant on agricultural activities.
Government policies have put severe pressure on employment in scores of public sector undertakings. Disinvestment, dismantling of public sector units and steadily falling state investment in employment-generating industries are posing serious challenges to the system developed after Independence. The policy trend of stopping or delaying recruitments has made matters worse. The policies of the governments welcoming foreign corporate bodies, very often on the investors' terms, have also contributed to the diminishing of job opportunities.
Time for another initiative It is in this context the NCSC Chairman's decision to press for extending reservation for Dalits to the private sector needs to be viewed. A few years ago, when a demand to that effect was raised, there was a positive response from at least some industrialists, but the global economic slowdown put an end to that. Now that the position has improved in many industrial and service sectors, it is time for another initiative by the government. It needs to remind private entrepreneurs, domestic and foreign, that they have a historic responsibility to help the state implement its social commitments. The question raised by the NCSC chairman is relevant: “When the deprived sections are taken care of, even in developed countries like the United States, why can't we have the same provisions here?”
The second item on the agenda of the NCSC is to get the Scheduled Castes Sub-Plan, which provides for each Ministry to allot special funds from its annual budget allocation for the benefit of Dalists, in proportion to their share in the population. The scheme, introduced in the early 1980s, has not been properly implemented for three decades. The Ministries are often charged with diverting funds under this head to other purposes.
The news media, which have recently been giving serious coverage to major Dalit problems and related issues in a complex situation, can make a real difference by bringing a new focus on the issues of reservation and the Sub-Plan. In addition to exposing atrocities against Dalits, the press, television, and radio should investigate systemic oppression, exploitation, and discrimination in greater depth.

Educational Loan-Interest subsidy available for this academic year too: Chidambaram

Union Home Minister P. Chidambaram has said that interest subsidy for educational loans will be available to the eligible candidates for the current academic year 2010—2011 also.
Speaking at a function organised at Vriddhachalam near here to give away educational loan on Saturday, Mr. Chidambaram said that the Centre had launched the interest subsidy scheme in 2009-2010 to help the candidates belonging to the economically weaker sections to take up higher education.
However, a debate was going on about the period of subsidy because it took time for the message to reach over one lakh bank branches across the country.
Hence, he made it clear that the interest subsidy would be available for the academic year 2010—2011 too, based on the eligibility criteria.
The aggrieved candidates, if any, could approach the Canara Bank for redress. Guaranteeing educational loan to all the eligible candidates Mr. Chidambaram called upon them to approach the banks with confidence.

NFDC to offer free courses for SC/ST and OBC students

The National Film Development Corporation Limited is conducting a one-month free training course for SC/ST candidates in the State.
The course, sponsored by the Tamil Nadu Adi Dravidar Housing and Development Corporation Limited, would train the candidates in digital non-linear editing (AVID and FCP), cinematography in video camera and multimedia. Candidates who have passed higher secondary examination can apply. They should be between the age group of 18 and 35 years.
Those who belong to BC, MBC and DNC can also apply for a free course on multimedia and audio dubbing, sponsored by the Backward Classes department.
Candidates, aged below 35, who have passed SSLC are eligible to apply.

The Position

Preference for BEST Apprentice/RUNNER UP Apprentice of All India Apprentices Competitions:

The candidates who were selected as BEST APPRENTICE or RUNNER UP APPRENTICE in the All India Trade Test conducted by the Directorate General of Employment and Training in the Trade Apprenticeship, NEED NOT appear for written test. They will be directly called for interview subject to fulfilling other terms and conditions and eligibility criteria. Best Apprentice will be inducted as Artisan Gr IV with 2 increments and Runner-up Apprentice will be inducted as Artisan Gr. IV in the pay scale of Rs.11700-23000/-.



Age Limit And Relaxation

The upper age limit is 27 years as on 01/10/2010, i.e. candidates should be born on or after 01.10.1983 and before 01.10.1992. A relaxation of 3 years for candidates from Other Backward Classes (Non Creamy Layer), 5 years for SC & ST candidates, is admissible in the upper age limit.

In Physically Challenged category, the General candidates will be allowed a total of 10 years of age relaxation, OBC (Non Creamy Layer) candidates a total of 13 years and SC/ST candidates a total of 15 years as per rules. All Ex-Servicemen will be allowed age relaxation to the extent of service plus 3 years (6 years in the case of OBC and 8 years for SC/ST).

A relaxation of 5 years in upper age limit is also admissible to candidates who were ordinarily domiciled in the State of Jammu & Kashmir during the period from 01/01/1980 to 31/12/1989.


Upper age limit is further relaxable upto 84 months to candidates possessing equivalent and relevant experience of working directly in a Public or Private Sector organization manufacturing Boiler components of not less than 100 MW capacity. This age relaxation of a maximum of 84 months will be applicable to candidates having aforesaid experience of 50 months of continuous or intermittent service. Those with lesser months of experience will be entitled for age relaxation on pro rata basis. Such candidates will have to compete with other eligible candidates in Written Test / Interview etc.

For claiming age relaxation, experience certificate from the employer/organisation is to be produced, with details of period of working, nature of products manufactured etc. Those engaged through a contractor directly in these operations would also be entitled to the relaxation. The experience certificate submitted by candidates for fulfilling eligibility criteria shall be subject to verification by BHEL and the decision of BHEL regarding authenticity / genuineness of experience certificates and relevance of experience shall be final and binding on the candidate. The Company will issue the offer of appointment for the candidates who get selected after availing this relaxation only after verification.

Emoluments & Other Benefits:
The selected candidates will initially be taken as Temporary Employees (Artisan) for a period of one year. On selection, all candidates will be required to undergo training including in allied trades. In addition, candidates selected for Crane Operator cum Rigger posts will be required to undergo specific training in crane operation and rigging for one year in the Company during the period as Temporary Employee (Artisan). During this period they will be paid daily wages prescribed by the State Government for the first six months and consolidated wages for the next six months. Currently the average wage on daily rated basis is Rs.5214/- p.m. and on consolidated wage is Rs.5500/- p.m. In addition, they will be entitled to free medical benefits for self and dependent family members and for subsidized company accommodation if available as per Company rules.
On successful completion of this period, they will be absorbed in the regular establishment as ARTISAN Gr. IV at the minimum of the scale of pay of Rs.11700-23000/- with applicable allowances such as Dearness Allowance, perks at 46% of basic Pay, HRA and other benefits like Uniforms, Leave, Contributory Provident Fund (PF), Gratuity, Group Insurance and Group Accident Insurance as per rules. The absorption in the regular establishment will be based on review of their performance/ behaviour / suitability to remain in the services of the Organisation as assessed by the Committee constituted for this purpose.

Health Standards
Applicants should have sound health. Before joining, selected candidates will have to undergo medical examination by the Company's Authorised Medical Officer and the appointment will be subject to meeting the health standards prescribed by the Company.

Selection Process

• All Eligible candidates will be invited for objective type Written Test to be held at Tiruchirappalli, for which they may download call letters from the website http://careers.bhel.in. No separate intimation will be sent to the candidates by post.

• The Question Booklets will be trilingual in English/Hindi/Tamil languages.

• All Eligible Ex-Servicemen candidates who possess the pass certificate of NTC/NAC or equivalent (% of marks not mandatory) in the relevant trade will be called for written test.

11. Candidates short-listed for interview, will be reimbursed Second class to and fro Train fare from the starting station or the mailing address whichever is nearer to the place of interview and back by the shortest route on production of proof of journey. No travelling allowance will be paid for appearing in the written test.

12. Acknowledgement Slips that are not in conformity with the requirements indicated in this advertisement, incomplete and those received after the last date and not accompanied with BHEL challan copy (wherever applicable) for payment of fee will not be entertained.

13. BHEL does not take responsibility of attaching the documents required as above or proof for payment of application fee if sent separately after the despatch of the Acknowledgement Slips.

14. Candidates will be required to undergo to medical examination by the Company's Doctor prior to their appointment after due selection.

Dalit youth executed ‘Taliban-style’ 
Six months after the mysterious death of a Dalit youth in Kannur district of Kerala, police have confirmed that he was in fact brutally tortured for hours. The death evoked widespread criticism with some terming it ‘‘Taliban-style execution by Islamic fundamentalists’’ and seeking a NIA probe. Eight of the 13 accused have been arrested and charged with ‘‘attempt to commit culpable homicide and abetment of suicide’’. Investigating officer P Sadanandan said, ‘‘The accused are Popular Front of India activists, a Muslim radicals group.’’
   But PFI’s Kerala president Naseeruddin Elamaram said he was not aware of the case. He said it had become a practice to associate any Muslim, who was arrested, with the outfit and added it was part of a conspiracy. The body of Vineesh, a casual labourer, was found hanging from the terrace of a lodge in Poythumkadavu in Kannur on April 17 this year. There were 22 brutal injury marks on the body.

Fence blocking road to Dalit colony in Krishnagiri removed

The barbed wire fence that was erected a few days ago blocking the approach road to a Dalit colony at Ittikkal Agaram village in Krishnagiri district was removed by Revenue department officials on Friday.Following a report in The Hindu, the district administration acted swiftly and removed the fence amidst tight security.Collector V. Arun Roy visited the spot and heard the grievances of the people and directed the department to immediately remove the fence and pave the way for the Dalits.



Oor Gounder (village leader), Nagaraj, told the Collector that the fence was erected by him on request from the Headmistress of the Panchayat Union Primary School in Ittikkal Agaram.Revenue Officials led by A. Noor Mohamed, Revenue Divisional Officer, and Tahsildhar P.M. Rajagopal and BDOs removed the fence. There was no resistance from caste Hindus, who watched the removal of the wire and stone pillars by workers.

Swift action:The barbed wire fencing blocking the approach road to the Dalit colony in Ittikkal Agaram village, near Krishnagiri, being removed under the supervision of Revenue officials on Friday.

In a release issued in the evening, Mr. Roy warned that stringent action would be initiated against those encroaching pathways and common places.D. Mahendran, Perambur MLA of the party

Dalit student’s novel protest against prof’s remarks

It was an day at Rajasthan University on Thursday when a Dalit student, Raj Tepan, came on horseback with his supporters and a musical band following him up to the vicechancellor’s office. Reason: Dalit students wanted to prove that the derogatory remarks made by their ‘guru’ PD Sharma were baseless.

Not just this, the agitating Dalit students demanded immediate arrest of Sharma, a retired university professor. They gave a memorandum to vice-chancellor AD Sawant to withdraw facilities given to Sharma, including pension and staff residential quarters.

Tepan said the motive for the drama was to teach a lesson to their professor who still believed that Dalit students were downtrodden and got no respect in the society. “Considering the remark, Sharma made at a seminar that “Dalits shouldn’t be allowed to ride a horse”, I decided to prove him wrong by coming to university on horseback along with a musical band,” he said.
A student of MA first year, Tepan, who claims to have been present at the seminar, said it was shocking to know that faculty members of reputed institution had such a mindset.

While meeting the vicechancellor, the students demanded that Sharma should apologize in public as he made remarks in seminar due to which the sentiment of Dalits were hurt. A similar memorandum was submitted to Circle Officer (Gandhi Nagar) Anil Rao in which they demanded Sharma’s arrest within three days.
Student leader Sunil Khatik alleged the police was not taking action against the guilty teacher and said a case was filed against PD Sharma after two days only when students’ group met a minister and were assured about action in the case. “If he is not arrested within three days, a statewide agitation will be launched to press the demands,” he said.


On Monday, a seminar was held on the occasion of foundation day of Social Science Research Centre in university campus during which a special lecture was delivered by PD Sharma. Soon after Sharma’s remarks on Dalits, students gathered and stopped the event and the premises were ransacked.

On Wednesday, Gandhi Nagar police registered a case on the complaints of students Lal Chand Verma and Raj Tepan while RU vice-chancellor AD Sawant issued an order to immediately relieve director and deputy director of Social Science Research Center (SSRC) from the assignment.
Professor says ‘sorry’:

Protests at Rajasthan University came to an end after Professor P D Sharma apologized to the students for over his anti-Dalit remarks at a meeting held under the chairmanship of food and civil supply minister Babulal Nagar on Thursday evening.

Narsee Kirad, general secretary of university students’ union, said he got a call from Sharma’s aide for a meeting to resolve the issue.

During the three-hour meeting, Sharma apologized to the students for his remark, which according to him was not intentional.

Can SC/ST benefits in one State be carried over to others?

Some people think that religion is not essential to the society. I do not hold this view. I consider the foundations of religion are essential to the society. At the roots of Hindu social system lies a Dharma as prescribed in the Manusmriti. Such being the case I do not think it is possible to abolish the inequality in the Hindu society unless foundations of the Smriti-religion is removed and a better one laid in its place. I however, despair of Hindu society, being able to reconstruct itself on such a better foundation.

Is a person belonging to a Scheduled Caste/Scheduled Tribe in a State entitled or not to benefits or concessions allowed to SC/ST candidates in employment in another State? The Supreme Court on Thursday referred this question to a larger Bench.
A Bench of Justices B. Sudershan Reddy and S.S. Nijjar, in its order, said: “A very important question of law as to the interpretation of Articles 16(4), 341 and 342 arises for consideration in this appeal: whether the Presidential Order issued under Article 341(1) or 342(1) of the Constitution has any bearing on the State's action in making provision for reservation of appointments or posts in favour of any backward class of citizens, which, in the opinion of the State, is not adequately represented in the services under the State? The extent and nature of interplay and interaction among Articles 16(4), 341(1) and 342(1) is required to be resolved.”

By referring the matter for determination by a larger Bench, the judges have virtually reopened the issue which was settled by earlier decisions of two Constitution Benches.

Earlier rulings
In the instant appeal, Uttarakhand was aggrieved at the judgment of the Uttarakhand High Court holding that SC candidates of other States were entitled to the benefits available to the SC in employment in certain posts in the G.B. Pant University of Agriculture and Technology.
Though the university appointed outsiders, the State terminated their services on the ground that they were not entitled to the benefits of SC in the State. However, the High Court quashed the termination orders without taking into consideration the ruling by the two Constitution Benches of the Supreme Court.
Initially, a five-judge Constitution Bench in the Marri Chandra Shekar Rao case held that when an SC/ST “migrates from one State to another, there is no inhibition to migrating, but when he migrates, he does not and cannot carry any special rights or privileges attributed to him or granted to him in the original State.”

A subsequent Constitution Bench — in the case of the Action Committee on the Issue of Caste Certificate to SC and ST in Maharashtra — reiterated the earlier decision and said the SC/ST must be specified in relation to a given State. Merely because a caste was considered an SC in one State, it was not necessary that it be considered so in another State also, the Bench said.
Later, a three-judge Bench in the S. Pushpa vs. Sivachanmugavelu case broadly agreed with the two earlier decisions. However, another two-judge Bench did not agree with the three judges' decision, stating it was made per incuriam (a decision which a subsequent court finds to be a mistake, and therefore not a binding precedent).
‘No dissent'
Now Justices Reddy and Nijjar said: “In our view, a two-judge Bench of this court could not have held the decision rendered by a three-judge Bench to be obiter and per incuriam. A Bench of lesser coram cannot disagree or dissent from the view of the law taken by a Bench of larger coram.
“In case of doubt, all that the Bench of lesser coram can do is to invite the attention of the Chief Justice of India and request that the matter be placed for hearing before a Bench of larger coram than the Bench whose decision has come up for consideration.”

However, since important questions of law were raised in this appeal, Justices Reddy and Nijjar referred it to the CJI for constituting a Bench of appropriate strength.
