OUR VIEWS on Recent development on reservation in promotion 117th amendment Bill

Loksabha has failed to pass the Reservation in promotion 117^th amendment Bill. The UPA Govt has not reciprocated the BSP support to the FDI bill and congress party is solely responsible for the plight of SC/ST people in this country. Mulayam Singh Yadav who used a Dalit MP to snatch the Bill had given interview against the reservation in promotion but the same backward leader along with Mu.Karunanidhi demanded reservation in promotion for their caste.

Leader Like Paswanji and Mayawatiji have supported Mandal commission report and reservation for those intermediate (backward )castes who are responsible for atrocities committed against SC/ST people in the country. Every SC/ST people have believed that If OBC gets reservation, in turn they will support and will implement the reservation for SC/ST in letter and spirit but our utter dismay backward community leaders have turned against the reservation in promotion amendment bill!?.

During the course of passing the Reservation amendment bill there were atrocities reported in the national dailies which are reproduced below to show those atrocities are reserved exclusively for SC/ST and committed by Mulaym singh castes and Mu Karunanithi castes people. News reported in the media is only sample, there are so many such incidents are not reported in the media.

The Electronic and Print media has also responsible for stalling the reservation amendment bill by projecting rape case. National crime records bureau has reported that every year,month,day and every hour thousands of dalits are murdered, women are raped, their houses are destroyed and their properties are damaged but these people conveniently concealed these atrocities have taken Delhi women rape issue to stall reservation amendment bill deliberately . Dr.Babasaheb had fought for one man one value in this country during his life time but No person in this world will accept all the man have equal value in India.

The women and its organization in India should realize that they were also treated as dalits in India, If they continuously fail to recognize the rights and plights of SC/ST women and If they witnessed as mute spectator the atrocities committed against SC/ST women they will also meet the same treatment from the male dominated, caste ridden society. The Delhi rape case is an example for this.

Quota Bill passed by huge majority in RS

Barring Samajwadi Party, an overwhelming majority in the Rajya Sabha passed the Bill that provides for quotas for SCs and STs in government job promotions. The Constitution amendment Bill was approved by 194 members in the 245-strong House. Nine from Samajwadi Party and an independent voted against the Bill.

The Bill is now likely to be introduced and moved for consideration and passing in Lok Sabha on Wednesday. The proposed legislation was the reason for the Lok Sabha being unable to transact any business during the day.

While the Bill was being debated in Rajya Sabha, SP Members repeatedly disrupted the functioning of the Lok Sabha with party president Mulayam Singh Yadav, who has threatened to review support, leading the protest in the House. In between adjournments, Parliamentary Affairs Minister Kamal Nath attempted to assuage Mr. Yadav’s apprehensions but to no avail. Congress MPs tried to counter the SP by raising counter slogans demanding the Bill be introduced in the Rajya Sabha at the earliest.

In the Rajya Sabha, besides voting against the Bill, SP urged reservation in jobs for Muslims by referring to the Justice (Retd.) Rajender Sachar Committee report that said their plight was worse than that of Dalits.

Minister of State for Personnel V. Narayanasamy said the government had incorporated some elements like a 22 per cent cap on promotions for which consideration of Annual Confidential Report will be crucial. He gave out figures to assert that discrimination against the SCs/STs and OBCs was rampant. He was amenable to Leader of the Opposition Arun Jaitley’s suggestion to ensure the amendments will not affect those who have already been promoted since 1995.

Anti-reservation protesters in U.P. peeved at BJP line

Employees of the Uttar Pradesh government on Tuesday targeted the Bharatiya Janata Party in the Rajya Sabha for voting in favour of the constitutional amendment Bill on reservation in promotion for the SCs. Raising anti-BJP slogans, they staged a sit-in and demonstration at the party headquarters on Ambedkar Marg opposite the Vidhan Bhavan here.

Some protesters smeared the walls of the nearby residence of BJP MP from Lucknow Lalji Tandon with black paint and threw sandals and slippers inside. Mr. Tandon was not present. Anti-quota protesters staged a demonstration before the MP’s residence on Sunday also. Police were deployed heavily at the BJP headquarters and at Mr. Tandon’s residence. Protesters burnt effigies of BJP and Congress leaders.

About 18 lakh State employees are on strike on a call given by the Sarvjan Hitaya Sanrakshan Samiti, an organisation of upper caste and OBC employees and officers opposed to the SC promotion quota. Samiti president Shailendra Dubey said the stir would continue till December 20 after which a meeting would be held to finalise further strategy.

With the caste divide among the State staff becoming deeper, the employees’ anger, particularly of those belonging to the upper castes and a section of the OBCs, against the BJP has rung alarm bells in the party. Already there is talk of a rethink in the party’s strategy on quota in promotion.

Party’s State unit president Laxmi Kant Bajpai has indicated that the BJP’s present stand on the proposed move would affect its chances in the 2014 Lok Sabha poll.

High drama as SP members tear up quota Bill

Member snatches Bill from Minister; Sonia tries to get it back

High drama unfolded in the Lok Sabha on Wednesday when a Samajwadi Party member snatched the copy of the quota in promotion Bill from Minister of State V. Narayanasamy when he rose to move it. Amid jostling and pushing, Congress president Sonia Gandhi tried to get the copy back from Yashvir Singh, but he flung it to his party members and then it was torn to pieces.

Yashvir Singh, representing Nagina in Uttar Pradesh, shocked the House, snatching the Bill from Mr. Narayanasamy. Then he flung it towards his party colleague Neeraj Kumar, even as Ms. Gandhi, seated in the first row, rushed towards Mr. Singh and tried to take it back.

This caused a huge commotion. As Congress members K. Bapiraju and Vilas Muttemwar walked towards Ms. Gandhi, a scuffle-like situation prevailed, with the SP members already in the well protesting against the Constitution (117th Amendment) Bill. Congress members surrounded Ms. Gandhi.

A stunned Speaker Meira Kumar adjourned the House for the day. Tempers ran high even after the adjournment, with members of the two parties blaming each other for the situation.

The Samajwadi Party has been isolated in its opposition to the Bill, which seeks to create a quota for the Scheduled Castes/Scheduled Tribes in promotion in government jobs.

Terming the incident “very deplorable and extremely unfortunate,” Parliamentary Affairs Minister Kamal Nath told reporters later: “We will urge the Speaker to condemn it and take action against the member.” “The Bill will be taken up tomorrow [on Thursday]…” Such an act “frustrates parliamentary democracy.”

Mr. Nath said that since Ms. Gandhi was closest to the spot where the incident occurred, she asked the member to return the Bill. “In a democracy, if you are against something, you vote against it. But you can’t do this. I condemn it. If they show such an attitude, there is no need for democracy or Parliament or the media.”

However, Samajwadi Party president Mulayam Singh Yadav, accompanied by his party members including Mr. Yashvir Singh, told reporters outside the Parliament House that the Congress had insulted Mr. Yashvir Singh. “The Congress has insulted our MP. Our MP was beaten, and now the channel has deleted [blacked out] the clipping…”

Mr. Yadav said SP had opposed the Bill all along and would continue to do so.

The Lok Sabha was repeatedly adjourned before the Bill was taken up, as the Samajwadi Party members stormed the well. As the House reassembled at noon after an adjournment and soon after question hour began, they trooped into the well, raising slogans.

Uproar over debate on Lokpal Bill

The Lokpal Bill will be brought in the Rajya Sabha during the budget session next February, Minister of State for Personnel V. Narayanasamy told the Rajya Sabha on Wednesday amidst uproar in the House for not discussing the report of the Select Committee on the Bill. The report was tabled in the Upper House at the beginning of the session.

Supporting the protest by CPI(M) members P. Rajeev and K.N. Balagopal over the delay in discussing the report, Leader of the Opposition Arun Jaitley said the report of the Select Committee had come and it was the property of the House, under Rule 93.

“The Chair can take a unilateral decision on discussing the report in the House. It was not a Standing Committee report on which the government had to take a view,” said Mr. Jaitley, who was a member of the committee.

As Mr. Rajeev and Mr. Balagopal came into the aisle on the issue, Deputy Chairman P.J. Kurien, who was in the Chair, asked them to go back, saying they were disrupting the proceedings and that they should have raised the matter in the Business Advisory Committee (BAC).

“Those parties who are represented in the BAC should raise it there and not here. The BAC allocates time. It is very easy to raise it there and get time. You should have asked your leaders to raise it,” he said.

Responding to the members’ demand, Mr. Narayanasamy said the government had accepted most of the suggestions of the Select Committee and would bring the measure in the Rajya Sabha after the Union Cabinet’s approval.

Interrupting him Mr. Jaitley said: “Please do not alter the Standing’s Committee’s report. This report is here and if the government wants, it must move its amendments on the floor of the House,” he said.

The Minister said: “We follow the rules. Yes, the government has to move amendments and the Leader of Opposition knows that we have to take the Cabinet into confidence. Therefore, the government will come up with its amendments to the report in the Budget Session and the House can discuss it.”

The Select Committee report makes it mandatory for States to set up Lokayuktas and suggests establishment of a Director of Prosecution under the CBI Director for Lokpal cases.

Samajwadi Party president Mulayam Singh Yadav condemned the incident in the Lok Sabha on the Bill on quota in promotions, but remained mum on withdrawal of his party’s outside support to the United Progressive Alliance government on the issue.

The SP Parliamentary Party will meet early Thursday morning to decide its course of action, even as the government said the Bill would be taken up when the House meets.

“Everybody saw what happened. This is a serious thing,” Mr. Yadav told journalists outside Parliament, referring to the incident in which Congress president Sonia Gandhi tried to retrieve the Bill from his party member who had snatched it from Minister of State V. Narayanasamy as he was trying to introduce it.

Without naming anybody, Mr. Yadav said, “The Congress is the ruling party. They can do as they want, but we will continue with our struggle [against the Bill] no matter what. This is a divisive Bill. It has been scrapped by court thrice.”

Accompanied by his party members, including Dalit member Yashveer Singh, who snatched the Bill, Mr. Yadav charged the Congress with “insulting” his party member. “And now the [Lok Sabha] channel has deleted [blacked out] the clipping. What was done to our party member was insulting.”

To a query whether his party would withdraw support to the UPA, he said, “We will think about it later. Right now we are talking about what happened today.”

“Charges are baseless”

Asked if it behoved well for a member to snatch the Bill from the Minister, Mr. Yadav said it was not the first time this had happened. He denied the allegation that the entire incident was planned. “The charges against us are baseless.”

Speaking to journalists outside Parliament, Congress MP Vilas Muttemwar denied he had “beaten up” the SP member. He said he only prevented him from approaching Ms. Gandhi.

The Bill has been approved by the Rajya Sabha. The SP opposed it vehemently in the Upper House too. Mayawati-led Bahujan Samaj Party has been demanding that the Bill be passed.

Chaos marks last day of winter session; protest by SP, BJP holds up bill

Repeated adjournments and disruptions on Thursday marred the proceedings in the Lok Sabha, which was adjourned sine die later in the day, with the bill to provide reservation for the SCs and STs in government job promotions, getting blocked by BJP and Samajwadi Party members.

The bill, supported vigorously by Mayawati’s BSP, got through the Rajya Sabha on Monday amid protests and walk-out by the SP.

Minutes before the month-long winter session ended, Speaker Meira Kumar regretted that her efforts to get the bill through did not succeed.

On Wednesday, the House witnessed high drama and scuffles as a SP member snatched a copy of the bill from Minister of State V. Narayansamy, even as Congress president Sonia Gandhi, amid jostling, tried in vain to retrieve it.

On the last day, the House was adjourned repeatedly, what with the pandemonium created by the SP and the BJP. As soon as Mr. Narayansamy moved the Constitution (117th Amendment) Bill, 2012, SP members rushed to the well, raising slogans.

As the din continued, senior BJP leader L.K. Advani was on his feet, seeking to speak on the subject, but a Congress member was speaking simultaneously. Irked at their leader not being allowed to speak, BJP members said it was an insult to the main Opposition party.

In the afternoon, when the House reassembled, BJP members trooped into the well, arguing that any insult to the Opposition would not be tolerated. Congress members, too, indulged in slogan-shouting. The pandemonium forced yet another adjournment.

When the House finally met at 5.30 p.m., the Speaker read out her valedictory remarks. She said the session had 20 sittings when seven bills were passed and seven others introduced. The House also held a discussion on foreign direct investment. Interruptions, followed by forced adjournments, cost the House 59 hours.

In the Rajya Sabha, which was also adjourned sine die , question hour could be conducted only on eight days, owing to continued disruptions.

U.P. employees call off strike

Congress, BJP bear brunt of Upper caste, OBC anger

The eight-day-old strike by about 18 lakh State government employees in Uttar Pradesh against reservation in job promotion for the SCs and STs was called off on Thursday, but not before the agitators staged a dharna before the BJP headquarters here objecting to the party’s support for the measure.

Shailendra Dubey, president of the Sarvjan Hitaya Sanrakshan Samiti, an organisation of Upper Caste and OBC officers and employees, told The Hindu that the strike was called off as the Lok Sabha, which was supposed to vote on Thursday on the 117th Constitution Amendment Bill providing for reservation, was adjourned sine die .

Mr. Dubey said a State-level meeting of the Samiti would be held here on December 23 to chalk out a strategy. The government employees would join duty on Friday.

Meanwhile, the Aarakshan Bachao Sangharsh Samiti (Save Reservation Action Committee) of the Scheduled Caste/Tribe officers and employees has also convened a meeting of its office-bearers for that day. Convener Avdhesh Varma said protest meetings would be organised in the constituencies of those MPs from Uttar Pradesh who are opposed to the promotion quota.

Even as government offices remained paralysed during the past eight days, it was the Congress and later the Bharatiya Janata Party which incurred the wrath of the strikers. From pulling down hoardings of prominent leaders to raising slogans, staging demonstrations at party offices, throwing eggs, rotten vegetables and shoes, and drawing graffiti on party vehicles and walls of residences of party leaders, the upper caste and OBC employees were quite vocal in their protest.

On Thursday, supporters of the Sarvjan Hitaya Sanrakshan Samiti staged a daylong sit-in at the BJP headquarters on Ambedkar Marg and protest meetings at the party office gate. A heavy police force had been deployed there. Protest meetings were also held at the nearby GPO Park.

Alarmed at the possibility of the party losing its Upper caste and OBC support base, a BJP delegation led by State unit chief Laxmi Kant Bajpai met national president Nitin Gadkari in Delhi and apprised him of the political situation. The agitating employees were emboldened by the stand taken by Samajwadi Party president Mulayam Singh against the Bill.

Tearing of SC/ST Bill: House rules advocate “stricter punishment”

A day after no action was taken against the Samajwadi Party MPs , who snatched a copy of the ‘Reservation in Quota Promotion Bill’ from Minister V. Narayanasamy in the Lok Sabha and tore it up, RTI activist Subhash Chandra Agrawal has argued that Parliament rules demand “stricter punishment”.

He said this “unparliamentarily” incident took place after an earlier incident last year in the Rajya Sabha where Rajya Sabha chairperson overlooked how Rajniti Prasad of the RJD tore the Lokpal Bill on December 31 last year .

Citing the RTI reply from the Rajya Sabha which talked about “suspension” of a member for “disregarding the authority of the chair…by persistently and wilfully obstructing the business of the house”, he said despite rules being there to act against such unruly behaviour of Parliamentarians, chairpersons usually avoid acting against such members.

“Time has come that rules may be re-written to be stringent enough to automatically cancel membership of legislators for such unruly behaviour without requiring any role of chairpersons/Parliamentary committees and/or Legislative Assembly/Council, which are usually unduly soft on unruly activities of legislators,” added Mr. Agrawal, demanding Parliamentary privilege be abolished by making proceedings of the House accountable to normal law of land. Arguing that the concept of Parliamentary privileges has only checked exposure of corruption, he referred to the fact that Supreme Court acquitted Parliamentarians involved in the infamous JMM bribery case only because their act of voting by being bribed was considered immunised under Parliamentary privilege.

Tears rolled down Gowramma’s cheeks as she narrated how her husband, a Dalit, was beaten up and threatened with dire consequences allegedly by “upper caste” people for refusing to continue with the traditional profession of their community.

Her husband, Rangaswamy (38), a daily wage worker, has been admitted to the government hospital at Channarayapatna after he was beaten up at Baddikere in Channarayapatna taluk on December 17.

“They ripped his clothes off, tied him up to a pole and beat him up severely. They also threatened to harm our two school-going daughters if he refused to obey their orders,” Ms. Gowramma told The Hindu here on Thursday.

“All this began after he refused to go around the village beating a drum to inform the residents about a village festival scheduled for next week. A few people came to our home in an autorickshaw around 10.30 a.m. on December 17 and took him away. I ran behind the auto only to find my husband being beaten up,” she said.

Ms. Gowramma said the “upper caste” people did not listen to her pleas. “They threatened to harm our daughters if the police was informed about the incident,” she said. Their relatives, Murthy and Kumar, rushed to the spot to rescue him. Mr. Murthy told The Hindu that the “upper caste” people continued to assault Mr. Rangaswamy in their presence. “They were about 200 people and we only two. They abused us and threatened us with dire consequences if we did not obey their orders,” he said.

No arrests yet

Mr. Rangaswamy’s family has filed a complaint against 12 people at the Nuggehalli police station. A first information report (FIR) was registered under the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act on December 18. However, no arrests have been made yet. The Nuggehalli police said four teams had been constituted to arrest the accused.

Caste, poverty termed a bigger violation of human rights

An agenda to preserve human rights provides an alternative to religion – which is used as a tool to violate human rights – and the Constitution which is flawed at times, said P.L. Dharma from the Department of Political Science, Mangalore University. However, he added, poverty and caste system caused violation of human rights more than the police or the State.

Talking at the national seminar “Human rights advocacy: A step to prevent human rights violations” organised at the SDM College of Business Management on Wednesday, Mr. Dharma said if the inequalities created by caste system and poverty continued in the country, human rights violations would continue. “For caste system, human rights come in the middle of a fight between modernity and tradition. Poverty is similarly unequal. The more capitalist we become, thereby more poverty increases, the more human rights violations there will be,” he said.

He said issues relating to human rights had become important and developing a discourse on this was a challenge, especially in an inherently unequal world. Moreover, Mr. Dharma said, countries in the West linked human rights with their financial aid.

‘Slum-dwellers across the State continue to be neglected’

None of the problems being faced by slum-dwellers in the State has been addressed by the BJP government, State convener of Slum Janandolan Karnataka A. Narasimha Murthy has alleged.

The State has seen three Chief Ministers in the last over four years, but the problems being faced by slum-dwellers remain the same, he said addressing a gathering near Town Hall Circle here on Tuesday.

Earlier, he welcomed the Slum Janashakthi Rajya Jatha when it entered the district and led a rally from the Deputy Commissioner’s office to the Town Hall Circle.

He said that slum-dwellers were considered vote bank by leaders of all political parties. However, they were neglected by these very leaders after the elections.

He alleged that for the past 20 years, the Tumkur district administration had failed to provide even a single house to the poor. District president of the Centre of Indian Trade Unions Syed Mujeeb, who inaugurated the programme by beating the drum, said politicians adopting “use and throw” approach towards slum-dwellers was condemnable.

Leader of Slum Janandolana Karnataka Issac Arul Selva was among those present.

8-year-old Dalit girl raped, killed in Bihar

In yet another shocking reminder of the routine violence suffered by women, an eight-year-old Dalit girl was allegedly raped and murdered in Bihar’s Saharsa district. The body was found in a canal on Tuesday morning, a day after she went missing from home.

The incident took place in the remote village of Belwara Punarwas, situated at a distance from the Kosi river. The child was from the Paswan community and belonged to a family of labourers. District hospital sources confirmed to The Hindu that the post mortem found evidence of rape.

“Around 6 p.m., my daughter had gone to my brother’s chicken coop to call him home,” the girl’s father told The Hindu on the phone.

“The place is located around half-a-kilometre from our house. She gave the message to him and started to return home. My brother told her to go ahead and that he would follow suit. The pathway to the coop is a proper road with houses on either side. I don’t know what happened on the way,” he said.

The police have so far registered a case of rape, murder and causing disappearance of evidence against unknown persons. Saharsa SP Ajit Kumar Satyarthi told The Hindu that the police were “sure” the crime has been committed by someone from the village itself.

“We suspect rape. Since this is an inside job, she could have been murdered lest she named her assaulter,” Mr. Satyarthi said.

The girl’s mother was inconsolable. “She ate, she went out; she was all of eight,” cried her mother on the phone.

“I was born in this village and grew up here. But I have never witnessed such an incident. She was not a grown woman; she was just a child. She was the oldest of my four children,” the father said.

The victim’s uncle said no top official had come to visit the family. “Only one inspector came to investigate. If someone is raped in Delhi, the nation is outraged. If someone is raped here, no one knows about it.”

Missing Dalit youth found dead

A Dalit student, missing since 13 December, was found dead in a water body at Velliangudi near Chidambaram on Wednesday.

Tension gripped several places of the district moments after the body was found by a villager. A group of agitated people set on fire a house of an uncle of the girl at Velliangudi with whom the boy had fallen in love. The fire triggered a gas cylinder explosion, causing extensive damage to a number of household articles. A tractor was also destroyed.

Police said that the youth, M. Gopalakrishnan (20) of Senninathan, was in love with R. Durga of same age of Baradhur. Both were students of a private college in Sri Mushnam.

It was alleged that Gopalakrishnan, who went to the house of Durga on December 12 after writing examination, did not return.

Suspecting foul play, Mayakrishnan, father of Dalit boy, filed a case with Sri Mushnam police, who registered a man-missing case.

He also filed a petition in the Madras High Court seeking a direction to the police to produce his son. On Wednesday, a few passers-by, found the youth’s body with many injures in a highly decomposed condition.

As information spread, a large number of his relatives and cadres of Viduthalai Chiruthaigal Katchi blocked the road at Saththamangalam, claiming he was brutally killed by a group belonging to an intermediate caste. They also claimed that a senior leader of PMK was behind the murder.

The protesters demanded the arrest of those behind the murder.

Though senior police and revenue officials held several round of negotiations the protesters did not relent.

The road roko was withdrawn after three hours following a promise that suitable action would be taken against the suspects. The body was taken to the government hospital in Chidambaram for post-mortem. There were reports that VCK cadres blocked traffic at Kumarakudi, Pinnalur and a few more places in Cuddalore district. Security has been beefed up in vulnerable places of the district.

Hearing on Friday

Meanwhile, the Madras High Court posted for further hearing on Friday the habeas corpus petition filed by the father of the youth. A mention was made before a Division Bench comprising Justices C. Nagappan and M. Sathyanarayanan, by the petitioner’s counsel, M. Radhakrishnan, during the course of the day that the boy’s body was found in a village in Cuddalore district.

In the petition, C. Mayakrishnan of Senninatham, Cuddalore district, said his son, M. Gopalakrishnan, was studying B.Com second year in an arts college at Sri Mushnam.

On December 12, around 7 p.m. his son left home for Sethiathope and did not return. On enquiries, he came to know that his son was talking to Durga, his college mate. Following her request, he dropped her at her house at Baradhur. The petitioner said he was informed by his son’s friends that Gopalakrishnan and Durga were in love for quite some time. He filed a complaint with Sri Mushnam Police on December 14, but the police had not taken any action.

Three days later, he sent representations to the government and the police authorities. It evoked no response.

Illegally detained?

The petitioner recalled the recent mob frenzy in Dharmapuri district following an inter-caste marriage. He feared that his son might have been illegally detained. He said the failure of the police to locate his son more than five days after his disappearance violated Article 21 of the Constitution. Hence, the present petition seeking a direction to the police to produce Gopalakrishnan before the court and set him at liberty.

ஒரு வழியாகக் கடந்த 17-12-2012 அன்று, இந்திய நாடாளுமன்ற மாநிலங்களவையில் எஸ்.சி./ எஸ்.டி. இனத்தவருக்கு அரசுப் பணி பதவி உயர்வில் இடஒதுக்கீடு வழங்குவதற்கான 117-வது சட்டத்திருத்த மசோதா, அவைக்கு வந்திருந்த உறுப்பினர்களில் மூன்றில் இரண்டு பங்கு பலத்துடன் நிறைவேறியுள்ளது. இனி எப்போது இம்மசோதா மக்களவையில் நிறைவேற்றப்படுமோ தெரியவில்லை.

இது தலித் மக்களின் பிரச்னை மட்டுமல்ல, இந்த தேசத்தின் பிரச்னையும்கூட. இந்து மதத்தின் சனாதன வித்தாக உருவெடுத்துள்ள சாதி எனும் கொடிய வேர், எல்லா இந்தியர்களிடமும் ஊடுருவிப் பாய்ந்து படர்ந்து நின்று நிலை கொண்டுள்ளது. எனவே, பிரமிடு வடிவிலான படிநிலைச் சாதிய சமூக அமைப்பில், உயர்ந்தோன் - தாழ்ந்தோன், மேலானவன் - கீழானவன், ஆதிக்கவாதி - அடிமைச்சாதி என்று மனித வேறுபாடு இயற்கைபோலவே காட்சியளித்து வருகிறது.

ஒடுக்கப்பட்ட சமூக மக்கள் சமூகரீதியாக முன்னேற வேண்டுமெனில், அவர்கள் சுயமாகச் சிந்திக்கும் திறனுடையவர்களாக மாற வேண்டும். அதற்கு அறிவு அவசியம். அந்த அறிவுக்குத் திறவுகோல் கல்வி. எனவே, இம்மக்களின் பிள்ளைகளை பள்ளிக்கு அனுப்ப வேண்டும் என்று திட்டமிட்டுச் செயலாற்றியவர் கோலாப்பூர் சமஸ்தான மன்னர் சாகு மகராஜ். ஒடுக்கப்பட்ட மக்களை உயர்த்துவதற்காக, பல வழிகளில் உதவிய இவர்தான் 1902-இல் முதன்முதலாக இவர்களுக்காக இடஒதுக்கீட்டையும் அமல்படுத்தினார்.

பட்டியல் வகுப்பினர் அல்லது, "ஷெட்யூல்டு காஸ்ட்' என்ற சட்டப்பூர்வமான பெயர்கொண்ட ஒடுக்கப்பட்ட மக்கள் சமூகம் உருவானதற்கு நீண்டதொரு வரலாற்றுப் பின்னணி உண்டு.

இந்தியாவில் மக்கள்தொகை கணக்கெடுப்பு, 1881-இல்தான் முதன்முதலாக நடைபெற்றது. அப்போது சமய ரீதியாகவும், வர்ண ரீதியாகவும் மட்டுமே மக்கள் வகைப்படுத்தப்பட்டார்கள். ஏனெனில் அப்போது இந்துக்கள் மற்றும் இஸ்லாமியர் என்ற பிரிவே மேலோங்கியிருந்தது. பின்னர் தொடர்ந்து 1891, 1901, 1921, 1931 என்று பத்தாண்டுகளுக்கு ஒருமுறை நடைபெற்று வந்த மக்கள்தொகை கணக்கெடுப்புகளில்தான் வகுப்பு ரீதியாகவும் படிப்படியாகக் கணக்கிட்டனர்.

""1919-இல் மாண்டேகு - சேம்ஸ்போர்டு திட்டம்'' கொண்டு வரப்பட்டு, ஆங்கிலேயரின் அரசாட்சியில் இந்தியர்களுக்கும் பங்களிக்கும் உரிமை பரவலாக்கப்பட்டது. பிரிட்டிஷ் அரசாட்சியில் இந்தியர்களுக்கும் பிரதிநிதித்துவம் வழங்கியபோது சமூக ரீதியாக விளிம்பு நிலை மக்களாயிருந்தவர்களின் பிரதிநிதிகளுக்கும் வாய்ப்பு தர வேண்டும் என்ற கோரிக்கை பாபாசாகேப் அம்பேத்கரால் முன் வைக்கப்பட்டு, பிரிட்டிஷாரால் ஏற்றுக் கொள்ளப்பட்டது. அதன்படி, இந்திய ஆட்சிப் பணியில் தீண்டாதாரும் இடம் பெற்றனர்.

அரசாட்சியில் பங்குபெறும் இந்தியப் பிரதிநிதிகளைத் தேர்ந்தெடுப்பதற்கான தேர்தல் முறையைக் கொண்டு வருவதற்காக பிரிட்டிஷார் ""சவுத்பரோ குழு''வை அமைத்தனர். இக்குழுவின் முன் தீண்டாதாருக்கான கோரிக்கை வைத்து பாபாசாகேப் அம்பேத்கர் வாதாடியதன் பயனாக, அவர்களுக்கும் சில பிரதிநிதித்துவம் வழங்கப்பட்டது.

""லார்டு சர். ஜான் சைமன்'' என்பவர் தலைமையில் ஒரு குழுவை நியமித்தது பிரிட்டிஷ் பேரரசு. இந்தியாவில் தீண்டாத மக்கள் படும் கொடுமை, அவர்களின் இழிநிலை ஆகியவற்றையெல்லாம் தொகுத்து, இதிலிருந்து விடுபடத் தேவையான வழிமுறைகளையும் வகுத்து, அதை சைமன் குழுவில் சமர்ப்பித்து தீண்டாத மக்களின் வாழ்வுரிமைக்காக வாதாடி நின்றார் பாபாசாகேப் அம்பேத்கர். பாபாசாகேபின் கோரிக்கையில் உள்ள நியாயத்தை உணர்ந்த ஆங்கிலேய அரசு, தீண்டாதாரின் உரிமை குறித்து, வட்டமேஜை மாநாட்டில் தீர்மானிக்கப்படும் என்று அறிவித்ததோடு, அந்த மாநாட்டில் தீண்டாதாரின் பிரதிநிதிகளாகப் பங்கேற்க பாபாசாகேப் அம்பேத்கர் மற்றும் தாத்தா ரெட்டைமலை சீனிவாசன் இருவரையும் அழைத்தது.

1930-இல் லண்டனில் நடைபெற்ற முதலாவது வட்டமேஜை மாநாட்டில் தீண்டத்தகாத மக்கள் மட்டுமே வாக்களித்து தங்களது பிரதிநிதிகளைத் தேர்ந்தெடுக்கும் தனித் தொகுதி முறையை நடைமுறைப்படுத்துவது குறித்து ஆவன செய்ய "லோதியன் கமிட்டி' அமைக்கப்பட்டது. இதன் மூலம் இந்தியா முழுவதும் குடியிருந்த தீண்டத்தகாத மக்கள் மாநில வாரியாகக் கண்டறியப்பட்டு, ஒரு பட்டியலுக்குள் கொண்டு வரப்பட்டனர். அதுவே "ஷெட்யூல்டு காஸ்ட்' என்ற இனமாக அடையாளப்படுத்தப்பட்டது. இதுவே 1935-ஆம் ஆண்டு இந்திய அரசாங்க சட்டத்திலும் அதிகாரப்பூர்வமாக அறிவிக்கப்பட்டது. அன்றைக்கு சென்னை, பம்பாய், வங்காளம், பஞ்சாப், பிகார், ஒரிசா, அசாம், காஷ்மீர் ஐக்கிய மற்றும் மத்திய என்று 10 மாகாணங்களைக் கொண்டிருந்த இந்திய நாட்டில் 429 சாதியினர் இந்தத் தீண்டத்தகாதார் பட்டியலுக்குள் கொண்டு வரப்பட்டனர்.

இந்தியாவிற்கு 1947-இல் சுதந்திரம் கிடைத்தது. 1950-இல் இந்திய அரசியல் சட்டம் அமலுக்கு வந்தது. ஆனால், அதற்கு 20 ஆண்டுகளுக்கு முன்னரே அதாவது, பிரிட்டிஷ் பேரரசு காலத்திலேயே தலித் மக்களுக்கான இடஒதுக்கீடு 1932-இல் போடப்பட்ட பூனா ஒப்பந்தத்தின் மூலம் அதிகாரப்பூர்வமாக நடைமுறைக்கு வந்துவிட்டது என்பது குறிப்பிடத்தக்க சரித்திரச் செய்தியாகும்.

இந்தியாவில் ஷெட்யூல்டு காஸ்ட் மக்களுக்கு வழங்கப்பட்டு வரும் இடஒதுக்கீடு என்பது மூன்று வகைப்படும்.

அதில் முதலாவது "தேர்தல் ஒதுக்கீடு'. இதில் வேட்பாளர் மட்டுமே எஸ்.சி.யாக இருப்பார். ஆனால், வாக்காளர்கள் அனைத்து சாதியினரும்தான். எனவே, பிற சாதியினரின் வாக்குகளை அதிகமாகப் பெறுபவரே வெற்றியடைய முடியும். எனவே, "தலித் மக்கள் தங்களுக்குரிய உண்மையான பிரதிநிதியைத் தேர்ந்தெடுக்க முடியாமல் போகிறது என்பதை இங்கே குறிப்பிட்டாக வேண்டும்.

இரண்டாவது கல்வி ஒதுக்கீடு. இதன் மூலம் படிப்பறிவு பெற்ற பட்டதாரிகள் ஷெட்யூல்டு சமூகத்திலும் வரத் தொடங்கினர். இந்தக் கல்வி ஒதுக்கீடு முறையால் இச்சமூகம் மெல்ல மெல்ல மேலெழும்பி வருகிறது.

மூன்றாவதாக வேலைவாய்ப்பு ஒதுக்கீடு. ஆண்டாண்டுகாலமாய் அடிமைச் சேவகம் மட்டுமே செய்வதற்குக் கட்டாயப்படுத்தப்பட்டு, கொடுமைக்குள்ளாக்கப்பட்ட தலித் சமூகம் தலைநிமிர அரசுப் பணி மிகவும் அவசியமாயிற்று. அவர்களுக்கும், ஆட்சியதிகாரப் பொறுப்பில் உரிய பங்கு வழங்க வேண்டும் என்ற நியாயமான உணர்வின் காரணமாகவே, வேலைவாய்ப்பில் இடஒதுக்கீடு கொண்டு வரப்பட்டது. ஆனால், இந்த இடஒதுக்கீடு சரிவரக் கடைப்பிடிக்கப்படாததால், இவர்களுக்குரிய பல லட்சம் பணியிடங்கள் இன்னும் காலியாகவே உள்ளன. இதேபோன்ற நிலைதான் பதவி உயர்வு ஒதுக்கீட்டிலும் நீடித்து வருகிறது.

என்னதான் சட்டம் நன்றாக இருந்தாலும் அதை நடைமுறைப்படுத்துபவர் நாணயமற்றவராக இருந்துவிட்டால் அந்தச் சட்டத்தால் என்ன பயன்? என்று பாபாசாகேப் அம்பேத்கர் வினா எழுப்பியதற்கேற்ப, இந்த இடஒதுக்கீடு மத்திய, மாநில அரசுகளால் முற்றிலும் முழுமையாக அமல்படுத்தப்படவில்லை. இம் மக்களுக்கான அரசுப் பணியிடங்கள் முழுமையாக நிரப்பப்படவில்லை என்பது ஒருபுறமிருக்க, வழங்கப்பட்டுள்ள இடங்களும் கடைநிலை ஊழியர்களின் பணிகளாக உள்ளதே தவிர உயர் பதவிகளில் நிலைவாரியாக ஓரளவுக்குக்கூட நிரப்பப்படவில்லை.

இந்நிலையில் இந்தியாவிலுள்ள பிற்படுத்தப்பட்ட மக்களுக்கும் இடஒதுக்கீடு வழங்குவதற்கு வகை செய்வதற்காக 1979-இல் நியமிக்கப்பட்ட மண்டல் குழு தனது அறிக்கையை 1980-இல் சமர்ப்பித்தது. இது பத்தாண்டுகள் கழித்து 1990-இல் அமல்படுத்தப்பட்டது. இதன்படி பிற்படுத்தப்பட்ட மக்களுக்கு மத்திய அரசுப் பணியிலே 27 விழுக்காடு நடைமுறைக்கு வந்தது. ஆக, இந்தியாவில் சமூகத்தில் ஒடுக்கப்பட்ட எஸ்.சி./எஸ்.டி. மக்களுக்கும் இடஒதுக்கீடு, ஒடுக்குகின்ற ஆதிக்கவர்க்கமான பிற்படுத்தப்பட்ட மக்களுக்கும் இடஒதுக்கீடு என்ற நிலை ஏற்பட்டுவிட்டது.

16-11-1992-இல் இந்திரா சஹானி என்பவரால் பிற்படுத்தப்பட்ட மக்களுக்கான இடஒதுக்கீட்டை எதிர்த்துத் தொடரப்பட்ட வழக்கில் வழங்கப்பட்ட தீர்ப்பில், ""எஸ்.சி./எஸ்.டி. ஊழியர்களுக்கு அரசுப் பணி பதவி உயர்வில் இடஒதுக்கீடு வழங்கக்கூடாது. இதை 5-வது வருடத்திலிருந்து அமல்படுத்த வேண்டும்'' என்று அந்த வழக்கிற்கு எந்தவிதத்திலும் தொடர்பில்லாத ஒரு பிரச்னையில் தீர்ப்பு வழங்கியது நீதிமன்றம்.

ஏற்கெனவே தலித் இனத்தாருக்கு இடஒதுக்கீடு வழங்குவதில் எவ்வளவு குளறுபடி செய்ய முடியுமோ, எவ்வளவு தாமதம் செய்ய முடியுமோ அதையெல்லாம் செய்து கொண்டிருந்த ஆதிக்க சாதி உணர்வு அதிகாரிகளால் இந்த நீதிமன்றத் தீர்ப்பு உடனடியாக நடைமுறைப்படுத்தப்பட்டது. அதன்படி, அரசுப் பதவி உயர்வில் இடஒதுக்கீடு வழங்குவது உடனடியாக நிறுத்தப்பட்டது.

அதனால்தான் மீண்டும் பதவி உயர்விலும் இடஒதுக்கீடு வழங்க வேண்டுமென்று தலித் மக்கள் குரல் கொடுத்தார்கள். கோரிக்கை வைத்தார்கள். போராட்டம் நடத்தினார்கள். அதனால் இதற்காக 1995-இல் 16(4ஏ) என்ற 77-வது சட்டத்திருத்த மசோதா இந்திய நாடாளுமன்றத்தில் தாக்கல் செய்யப்பட்டது.

இதன்படி எஸ்.சி., எஸ்.டி., ஊழியர்களுக்குப் பதவி உயர்வில் மீண்டும் இடஒதுக்கீடு வழங்க வகை செய்யப்பட்டது. ஆனால், இது நடைமுறைக்கே வரவில்லை.

இதை எதிர்த்து எம். நாகராஜ் என்பவர் நீதிமன்றத்தில் வழக்குத் தொடுத்தார். இவ்வழக்கை விசாரித்த உச்ச நீதிமன்றம் தனது 19-10-2006-இல் வெளியிட்ட தீர்ப்பில் கீழ்க்காணும் 3 நிபந்தனைகளை விதித்தது.

1. அரசின் உயர் பதவிகளில் இடம் காலியாக இருக்கிறது என்பதை அரசு உறுதிப்படுத்த வேண்டும்.

2. இப்பதவிகளில் எஸ்.சி., எஸ்.டி. ஊழியர்களை நியமிக்கும் அளவுக்கு அவர்கள் பாதிக்கப்பட்ட நிலையில்தான் உள்ளார்கள் என்பதை அரசு ஊர்ஜிதப்படுத்த வேண்டும்.

3. இப்பதவிகளில் எஸ்.சி., எஸ்.டி. ஊழியர்களை நியமனம் செய்தால் அரசின் நிர்வாகத் திறன் எந்தவிதத்திலும் பாதிக்கப்படாது என்று அரசு உத்தரவாதம் அளிக்க வேண்டும்.

இந்த மூன்று நிபந்தனைகளைத் தெளிவாக்கிய பின்னர்தான் பதவி உயர்வில் எஸ்.சி., எஸ்.டி. ஊழியர்களுக்கு இடஒதுக்கீடு வழங்கலாம் என்று தீர்ப்பு அளிக்கப்பட்டது.

இந்நிலையில் உத்தரப் பிரதேசத்தில் முதலமைச்சராக பதவியேற்ற பகுஜன் சமாஜ் கட்சித் தலைவி செல்வி மாயாவதி, மேற்காணும் மசோதாவை மையப்படுத்தி அரசுப் பணி பதவி உயர்வில் இடஒதுக்கீடு வழங்க உத்தரவிட்டார். இதை எதிர்த்து அலகாபாத் அமர்வு உயர் நீதிமன்றத்தில் வழக்குத் தொடுத்தார்கள்.

இவ்வழக்கினை விசாரித்த நீதிபதிகள் தல்வீர் பண்டாரி, தீபக் மிஸ்ரா ஆகியோர் வழங்கிய தீர்ப்பில், தாழ்த்தப்பட்ட வகுப்பு ஊழியர்களுக்குப் பதவி உயர்வில் இடஒதுக்கீடு வழங்க வலுவான சட்ட ஆதாரமில்லை என்று கூறி உத்தரப் பிரதேச அரசாணையை 28-4-2012 அன்று ரத்து செய்து விட்டனர்.

இதன்பிறகு 4.9.2012-இல் மத்திய அமைச்சரவைக் கூட்டத்தில் விவாதித்து, பதவி உயர்வில் இட ஒதுக்கீடு வழங்குவதற்கான மசோதாவை நாடாளுமன்றத்தின் இரு அவைகளிலும் தாக்கல் செய்து ஒப்புதல் பெறுவது என்று தீர்மானிக்கப்பட்டது. இந்த 117-வது சட்டத்திருத்த மசோதா மூலம் எஸ்.சி., எஸ்.டி. ஊழியர்களுக்குப் பதவி உயர்வில் இடஒதுக்கீடு வழங்க எந்தவித நிபந்தனையையும் பின்பற்ற வேண்டிய தேவையில்லை என்று சட்டப் பாதுகாப்பு செய்யப்பட்டுள்ளது அவ்வளவே. அதாவது ஏற்கெனவே இருந்த உரிமை, பறிக்கப்பட்ட உரிமை திரும்பத் தர வழி வகுக்கப்பட்டுள்ளது.

மத்திய அரசின் செயலாளர் அந்தஸ்தில் எஸ்.சி. ஒருவர்கூட இல்லை. கூடுதல் செயலாளர்களில் ஓரிருவரே உள்ளனர். நூற்றுக்கும் மேற்பட்ட துறைவாரியான செயலாளர்களில் ஐந்தாறு எஸ்.சி. மட்டுமே உள்ளனர். மாநில தலைமைச் செயலாளர்கள் யாருமே இல்லை. உச்ச நீதிமன்றத்தில் எஸ்.சி. நீதிபதி இல்லை. உயர் நீதிமன்ற நீதிபதிகளில் ஓரிருவர் மட்டுமே உள்ளனர். பிற அரசு நிறுவனங்களிலும் உயர் அதிகாரிகளாக எஸ்.சி. இனத்தவர் இல்லை என்கிற நிலை, பட்டியல் இனத்தவர்கள் வேண்டுமென்றே புறக்கணிக்கப்படுகிறார்கள் என்பதைத்தானே காட்டுகிறது?

பதவி உயர்விலும் இடஒதுக்கீடு என்பதை பிற்படுத்தப்பட்டவர்களுக்கும், இஸ்லாமியர்களுக்கும்கூட நடைமுறைப்படுத்த வேண்டும் என்று முலாயம்சிங் கருத்தறிவிக்கிறார். அதை தி.மு.க. தலைவர் கருணாநிதி ஆதரித்து அறிக்கை விடுகிறார். அப்படியானால், பதவி உயர்வில் எஸ்.சி.க்கு இடஒதுக்கீடு வழங்கினால் அரசு நிர்வாகத்தில் திறமை போய்விடும் என்கிறார்களே, இடஒதுக்கீடு பிற்படுத்தப்பட்டவர்களுக்கும் வழங்கினால் மட்டும் திறமை போய்விடாதா? இதென்ன பித்தலாட்டமான வாதம்?

அரசுப் பணியில் பதவி உயர்வு என்பது வெறும் மூப்பு வரிசை (சீனியாரிட்டி) அடிப்படையில்தான் வழங்கப்படுகிறது. அப்படியானால்... 100 அலுவலர்களில் 22 பேர் எஸ்.சி. என்றால், இதில் கண்காணிப்பாளராகப் பதவி உயர்வு பெறும் 50 பேரில் 11 பேர் எஸ்.சி. என்று நியமனம் பெறுவதுதானே நடைமுறை நியாயம்?

÷இன்றைய மாணவர்களில் எஸ்.சி./எஸ்.டி. மாணவர்கள் எடுக்கும் உச்சகட்ட மதிப்பெண்களுக்கும் பிற ஜாதி மாணவர்கள் எடுக்கும் உச்சகட்ட மதிப்பெண்களுக்கும் இடையிலுள்ள வேறுபாடு வெறும் அரை மதிப்பெண், ஒரு மதிப்பெண் என்ற அளவில்தான் உள்ளது என்கின்றபோது, தலித் மக்களின் திறமைக்கு என்ன குறைச்சல் என்ற கேள்விக்கு எவரால் பதில் கூற முடியும்?

இடஒதுக்கீடு மூலம் அரசுப் பணியில் அமரலாம். ஆனால், பதவி உயர்வில் மட்டும் அது கூடாது என்கின்ற வாதம், இம்மக்களை அதிகாரப் பதவியில் அமர்த்தாமல் அடிமட்ட வேலைகளிலேயே நிறுத்திக் கொள்ளும் வஞ்சகத்தனம்தானே தவிர வேறில்லையே?

÷இப்போது தாக்கல் செய்யப்பட்டுவரும் மசோதா, பதவி உயர்வில் எஸ்.சி.க்கு இடஒதுக்கீடு வழங்க வகை செய்யும் மசோதா என்றே பலரும் புரிந்து கொண்டுள்ளார்கள். அப்படியே பேசியும் வருகிறார்கள். அது தவறு. பதவி உயர்வில் இடஒதுக்கீடு வழங்க வேண்டுமென்று 1995-ஆம் ஆண்டே மசோதா தாக்கல் செய்யப்பட்டு நிறைவேற்றப்பட்டுவிட்டது. ஏற்கெனவே வழங்கப்பட்டுள்ள பதவி உயர்வில் இடஒதுக்கீடு என்ற சட்டத்தில் சரியானபடி வாக்கிய அமைப்பு இல்லை என்பதால், அதை விதிமுறைப்படி திருத்தம் செய்வதற்காகக் கொண்டு வரப்படும் ஒரு துணை மசோதா அவ்வளவே!

÷நாடாளுமன்றம் மறு தேதி குறிப்பிடாமல் ஒத்தி வைக்கப்பட்டுள்ள நிலையில், இனி மக்களவை எப்போது கூடி, இதனை எவ்விதம் நிறைவேற்றும் என்பது தெரியவில்லை. ஒடுக்கப்பட்ட மக்களின் உன்னதத் தலைவர் பாபா சாகேப் அம்பேத்கர் எடுத்துரைத்ததைப்போல் "உலகம் எவ்வளவுதான் விஞ்ஞானப்பூர்வமாக வளர்ந்தாலும் இந்தியா மட்டும், அது கடைப்பிடிக்கும் சாதிய வர்ணாசிரம சதிக்குள் சிக்குண்டு முன்னேற்றத்தைத் தடுக்கும் முட்டுக்கட்டையாகவே கிடக்கும்' என்ற தீர்க்கதரிசன வாசகம்தான் நம் நினைவிற்குள் சுழல்கிறது.
