Discrimination against SC/STs in Housing Schemes by Government of Tamilnadu.

"The minorities in India have loyally accepted the rule of the majority which is basically a communal majority and not a political majority. It is for the majority to realise its duty not to discriminate against minorities. Whether the minorities will continue or will vanish must depend upon this habit of majority.              The Government of Tamilnadu has launched a new housing scheme called Kalaignar Housing Scheme with a target of 3 Lakhs houses to be built before 31.03.2011. The amount allocated for this scheme is Rs 75 thousands for each house and the Government will provide cements and steel with an area of 250 Sq ft house, whereas under theTHADCO housing scheme (Indra Awaas Yojana) the construction area limited to 150 Sq ft without toilet/bathroom in 3 cents land. In Periar samuthuvapuram each house is constructed with Rs 2,50,000 with five cents of land for each house separate toilet, bathroom with septic tank and soak pit. It is apparent that this government is not willing to give more land and fund if the scheme is meant for SC/STs alone whereas the schemes involving all communities the government is liberal in allotting land and funds. Ans: No. The institute/college/school in which the scholar student is pursuing his/her course will send six monthly academic performance report in respect of each scholar which must be satisfactory. The respective institute must send the performance report of each Indian Oil Scholar to the administrator of the scheme (ACE Consultants ) certifying that the scholar has been satisfactorily promoted to the next academic session.
Q. Once I apply, when will get the confirmation about selection?
Ans: Potential candidates from top of the merit will be requested to send requisite documents. Only those found meeting the criteria in all respects will be recommended for award of the scholarship. After completing the official formalities/required approvals the list will be displayed on the website (after complete allotment of all vacancies) during Feb-April.
Q. I had been IndianOil Scholar during my last course of 10+. Now I am doing Engineering /MBBS will I automatically get the scholarship again?
Ans: No. You have to apply a fresh again and complete the formalities as per existing Terms & Conditions.

Applications in the prescribed format are called for from candidates for the posts of Postal Assistant / Sorting Assistant / Postal Assistant (SBCO) / Postal Assistant (CO/RO) / Postal Assistant (Foreign Post) / Postal Assistant (Mail Motor Service) for the direct recruitment vacancies of 2009 and 2010.
The total number of vacancies is 615.
The number of vacancies is likely to increase. There may be upward revision in each category, i.e, UR / SC / ST / OBC.
The examination to fill up these posts will be held simultaneously throughout the country on 14.11.2010 at 10.00 AM.

The undersigned is directed to refer to this Department's
O.M.No.36028117i2001-Est(tR.e s.) dated I lLhJ uly: 2002 which clarified
that SC/ ST candidates appointed by promotion on their own merit and not
owing to reservation or relaxation of qualifications will be adjusted against
un-reserved points of the reservation roster and not against reserved points.
It was subsequently clarified by this Department's O.M. No.3602811712001-
Estt. (Res.) dated 31.1.2005 that the above referred O.M. took effect from
11.7.2002 and that concept of own merit did not apply to the promotions
made by non-selection method.
2. Central Administration Tribunal, Madras Bench in O.A. No.90012005
[S. Kalugasalamoorthy vls. Union of India & Others] has set aside the O.M.
No.36028~1712001-Estt. (Kes.) dated 31.1.2005 and held that when a person
is selected on the basis of his own seniority. the scope of considering and
counting him against quota reserved for SCs does not arise. The High
Court of judicature at Madras in the matter of UOI vs.
S. Kalugasalamoorthy [ WP No.1592612007 ] has upheld the decision of the
Central Administrative Tribunal.
3. The matter has been examined in the light of the above referred
judgments and it has been decided to withdraw O.M. No. 36028/17/2001-
Estt. (Res.) dated 31.1.2005 referred to above. It is clarified that SC/ST
candidates appointed by promotion on their own merit and seniority and not
owing to reservation or relaxation of qualifications will be adjusted against
unreserved points of reservation roster. irrespective of the fact whether the
promotion is made by selection method or non-selection  method These
orders will take effect from 2.7.1997. the date on which post based
reservation was introduced.

RESERVATION IN PRIVATE SECTOR

MINISTER FOR SOCIAL JUSTICE MUKUL WASNIK HAS SLAMMED INDUSTRY BODIES AND CHAMBERS FOR BEING LAGGARD IN MAINTAINING EVEN BASIC RECORDS OF EMPLOYMENT FIGURES OF BACKWARD COMMUNITIES IN THE PRIVATE SECTOR
The green signal to caste-based census enumeration has also put the spotlight back on the whole question of reservations including affirmative action in the private sector.M inister for social justice and empowerment Mukul Wasnik has prepared a status report on the progress on that front and slammed industry bodies and chambers for being laggard in maintaining even basic records of employment figures of backward communities in the private sector.
It may be recalled that as far back as 2006, the issue of affirmative action in the private sector was taken up with industry bodies volunteering a code of conduct to help increase access to employment by backward communities.Prime Minister Manmohan Singh at that time had asked his principal secretary TKA Nair to look into the matter.
After being in cold storage for sometime Wasnikhadstirredthe
coals yet again by writing a letter to Prime Minister Manmohan Singh on the matter in May this year.H e had been asked to prepare a status report on the issue thereafter.
The document, accessed by Financial Express states explicitly that, “the number of companies which have adopted a code of conduct on affirmative action remains limited. In respect of Ficci and PHDCCI this information is
not available.” The voluntary code also enjoined upon companies to initiate skill development among backward communities,w hich toohave beenfound to be lacking.
The report states,“ CII, Assocham, and Ficci have taken certain steps for skill development of the SC/ST youth, the actual training provided is quite marginal.” “The number of companies which are reporting data on appointment of SC and ST in their annual reports is also not available,”the report said.
The report makes it clear that, “there is no information available on the appointment of an Ombudsman by Industry Associations to monitor compliance with the voluntary code of conduct.” In the UPA-I, the issue of affirmative action in the private sector had been a big issue,but had gradually lost steam thereafter.
Wasnik’s report is to revive the process yet again.

Post Office may soon become a full fledged bank

The neighbourhood post office may soon become a full-fledged bank as the government could facilitate a bank licence for India Post as part of a multi-pronged strategy to achieve greater financial inclusion.
The Reserve Bank of India is expected to soon come out with draft guidelines on licences to new banks.
“India Post is a strong contender for banking license given its spread across the country,” said a finance ministry official.
The postal department already works as a quasi bank, providing a host of savings products, postal life insurance, pension payments and money transfer services through its 1.55 lakh branches, more than any other bank.
It, however, does not provide credit, the most important bit of financial inclusion. A banking licence will help fill that gap enabling the delivery of modern banking facilities in areas lacking access to financial products, credit and savings. The department is expected to soon seek the required clearances from the Postal Services Board to expedite the process.The Department of Post has already hired international consultancy firm Accenture to modernise the post offices across the country, which will also help create infrastructure for banking services. “Once the infrastructure in place, we will able to assess if we need to rope in another player or not and accordingly get clearances from the RBI,” said an official with the Department of Post, adding that a Cabinet approval will also be required before commencing operations.
The idea of the Department of Post evolving into a bank has been around for a while. In 2006, India Post had even decided to appoint consultants to chalk out a regime for the transformation.
“There was a proposal to set up a bank with an initial capital of Rs 1,000 crore. The bank was to be set up as a subsidiary with the postal department holding a 51% stake in it,” said the finance ministry official.
More recently, the idea of a banking licence for India post was discussed in the inter-ministerial committee for financial inclusion, said an official of the Postal Services Board adding that the organisation was keen to provide banking services.
It is already working on core banking solution (CBS) for nearly 4,000 of its branches, which will allow customers to operate their accounts from any of the networked branches. The department has provided for Rs 106 crore towards development of CBS software.
Both the government and RBI have indicated that financial inclusion will be major criteria for giving new banking licences. “The final decision on granting a new licence will be taken by RBI. It will be a consultative decision as India Post is a government arm,” the official said.
A government committee on financial inclusion had also recommended that “India Post, with its ubiquitous reach should actively position itself to offer a low-cost, light-weight bank account to anyone enrolling for a Unique Identity Number.”
As per the committee report, nearly 16 crore people use India Post to save Rs 3,23,781 crore as on March 31, 2007. Out of this, deposits in savings bank account alone is Rs 16,789 crore, which makes a strong case for India Post to deepen the level of financial transactions and offer banking services to the rural population.
The Thirteenth Finance Commission has even proposed a budget of Rs 3,000 crore to be used for delivering an incentive of Rs 100 into the bank account of each BPL resident who enrolls for the UID Project.

50,000 Teachers belonging to SC/STs seeking jobs in Tamilnadu.

As on 31.05.2009 49,400 second grade teacher,B.T Assistant and PG B.Ed are waiting in the job seekers list of Tamilnadu employment Exchange. Home Minister P.Chidambaram refuses to accept the 22.67% SC/ST Population in Tamilnadu

"The basis of my politics lies in the proposition that the Untouchables are not a sub-division or sub-section of Hindus, and that they are a separate and distinct element in the national life of India".- Babasheb Dr.B.R.Ambedkar.

While welcoming Selvaperunthagai into congress fold, the Home minister welcomed the Dalit leader to join congress saying that “The Congress cannot become the principal party in TN without the support of dalits, and no party which wants to be number one can ignore a section that accounts for 18% or 19% of the population,”.  Accoring to 2001 census the SC/STs population is 22.67% this facts neither accepted by the P.Chidambaram nor Karunanithi for giving reservation in their party or in Government services.

A concerted effort is on in the Congress in Tamil Nadu to win back its dalit base. The endeavour is being spearheaded by Union home minister P Chidambaram who, on Sunday, invited the scheduled castes to join the Congress, saying that it was the only party that could give them due recognition.

As the party enthusiastically welcomed dalit legislator K Selvam, formerly in the Viduthalai Chiruthaikal Katchi and later state president of the Bahujan Samaj Party, into its fold, its leaders sounded upbeat about reviving the party’s original support base among the oppressed classes.

“The Congress cannot become the principal party in TN without the support of dalits, and no party which wants to be number one can ignore a section that accounts for 18% or 19% of the population,” Chidambaram said, after party leaders honoured Selvam with shawls.

At the function, Congress leaders emphasised that it was not good for the dalits, who had once been with the party, to be scattered among various parties. And Chidambaram remarked that as long as dalit leaders were in the Congress, atrocities against the scheduled castes were under control. Chennai: The Congress in Tamil Nadu on Sunday celebrated the entry into its fold of dalit legislator K Selvam, also known as Selvaperunthagai. Selvam, who was elected to the state assembly on a Viduthalai Chiruthaikal Katchi (VCK) ticket, and had a brief stint as president of the Bahujan Samaj Party’s state unit, still retains his MLA seat.

Whether Selvam’s entry into the Congress would boost the party’s electoral prospects in Tamil Nadu is debatable, but its leaders gave the impression that they saw the event as a precursor to the revival of the party’s dalit vote bank. And they hoped dalits would not be scattered among different identitybased parties, but would embrace the Congress.

As a large number of young supporters of Selvam greeted each reference to his name with applause and whistles, Congress leaders appeared happy to have roped in a dalit leader with a youth following. For, as the party’s deputy leader in the legislature D Yasodha pointed out, the Congress has seen the erosion of its dalit base over the decades. “The Congress needs the support of dalits to become the principal party in Tamil Nadu,” said Union home minister P Chidambaram.

Chidambaram said that when dalit leaders were in the Congress, atrocities against the scheduled castes were under control. “It was only when they left the party that atrocities began to increase.” He also said the credit for the good performance of dalit leaders in India should go to the Congress for providing them the opportunities, giving the examples of Babasaheb Ambedkar and Babu Jagjivan Ram.

Chidambaram referred to former state home minister P Kakkan, a dalit stalwart of the Congress whose centenary celebrations were held in Madurai on Saturday, and said tireless work, great personal integrity and boundless love for the poor were the reasons behind Kakkan’s rise in public life, despite his humble birth and sparse education.

Wishing that others would emulate him, he said Kakkan was the first dalit president of the state Congress, and there were two more — Maragatham Chandrasekar and L Elayaperumal. The day was not far off when another dalit could occupy the post. “The government will give you concessions, jobs, land and loans, but only a political party can give you status and recognition. That party is the Congress,” he said.

Selvam said his mind had been poisoned against the Congress in the past, but had now been touched by the affection of Congress leaders who, he had once thought, were not easily approachable.

TNCC president KV Thangkabalu and other Congress functionaries including S Thirunavukkarasar and Karthi Chidambaram felicitated Selvam and his supporters for joining the party. Ravi Mallu, a Congress leader from Andhra Pradesh who is an observer for the TNCC, appealed to Chidambaram to continue with his efforts to win over dalits to the party’s ranks.

We have heard learned counsel for the parties.
During the course of hearing of this batch of appeals, the appellants represented by the Director(Staff), Ministry of Communication & I.T., Department of Posts filed an additional affidavit which may put an end tothe controversy between the parties. In fact, the said additional affidavit has been filed pursuant to certain observations made by this Court while hearing the appeals.
It is evident from the affidavit that the entire matter was reconsidered by the Department and upon such reexamination based on humanitarian considerations, found that out of 204 respondents in all 202 respondents working in the Department against short term/leave vacancies can be accommodated against compassionate appointment vacancies for the years 2000-01 to 2009 as per the departmental guidelines. However, in the case of Postal Assistants (PA)and Sorting Assistants (SA) cadre, according to the Ministry, the number of vacancies is not enough to accommodate all of them in the cadre. It is stated that the number of vacancies earmarked for this period is only 113 whereas the number of respondents claiming the relief is 152. However, it is stated that as a one time measure, the Department is willing to accommodate them against residual vacancies of the Department. The statement made in the affidavit is made part of the record directing the respondents to act upon the same.

In the circumstances, the appellants are directed to regularize the services of all the 202 respondents who are working in the Department against short term/leave vacancies with effect from their date of appointment.
However, the respondents shall not be entitled for payment of any arrears on account of such regularization. But their pay and pensionary benefits are protected.
In view of this order, it is made clear that the findings recorded by the Tribunal and as well as the High Court with regard to the interpretation of office memorandums and circulars of the Department are set aside and those findings and observations shall not be treated as precedent for the purpose of any other case or cases that may be pending.
The questions of law, if any, are left open.
The appeals are accordingly disposed of without any order as to costs. The interlocutory applications are accordingly allowed.

Media has lost its sense of Priorities: Sainath.
Pointing out that a disconnect exists between mass media and mass reality in India today, P.Sainath,Rural Affairs Editor the The Hindu,said the media had lost its sense of priorities and was out of touch with the problems of a vast section of the population of the country. He was delivering the Silver Jubilee Lecture on “Mass media: But where are the masses?” at the Indira Gandhi Natinal Open University here on Wednesday. Noting that the media coverage and editorials following the recent oil price hike failed to fully understand the implications this would have on poor people, Mr.Sainath said he was surprised that the coverage given to this issue was dwarfed by a model’s suicide in some newspapers.

“In the last 15 years, everthing that has become a convenience to the upper and middle class has become cheaper. You take air tickets, computers, cars etc… they are all affordable for us . But in this same period rice, wheat, electricity, water, etc has become 300-500 per cent more expensive for the poor. Why is this not reflected in the media?” On stories of rural resurgence appearing in various magazines in 2010 he quipped that these stories “tiemed well” with the national crime records bureau statistics indicating 2,00,000 suicides since 1997 and three Government appointed commissions recommending the pushing up of official figures of population living below the poverty line.
The veteran journalist said the media to day had a “structural compulsion to lie as several media companies had interests in various arms of the economy. He commented that “private treaties” and “paid news” were undermining the media’s credibility. “Out of the ruins of private treaties, emerged paid news. Private treaties which gave media companies financial stakes in companies became worthless after the stock market tanked in 2008-09. Paid news enabled these corrupt companies and politicians to make unrecorded cash transactions during the Assembly and Genreral Elections in 2009”
Mr.Sainath also mourned the disappearance of number of social sector beats from newspapers. “Today newspapers have no labour correspondent, housing or primary education correspondent. We are explicitly telling 70 per cent of this country that they don’t matter to us”.

Reservation in Private sector opposed by Financial Express Under the guise of merit and efficiency

Reservations are inefficient in tackling inequity in opportunities

THE latest chapter of the Indian reservation saga involves the Department of Industrial Policy and Promotion (DIPP), under the Union commerce and industry minister Anand Sharma, telling the corporate sector that companies benefiting from various government incentives may be asked to reserve about 5% of employment needs for the SCs and STs. This development has to be seen in continuity with the common minimum programme announced by UPA-1, wherein "a national dialogue with all political parties, industry and other organisations" was promised to figure out how affirmative action should be handled. Even at that time, the industry chambers--the Confederation of Indian Industry, the Federation of Indian Chambers of Commerce and Industry and the Associated Chambers of Commerce--expressed scepticism about quota legislation. And the pattern is being repeated in the present moment, where the chambers are once again arguing that reservations in the private sector will adversely affect merit and efficiency . Overall, this argument goes, India's comparative advantage will take a hit if reservations become de rigueur. We must note that the objecting parties are not against affirmative action per se.
The question is whether transmission losses between theory and practice are worth the gains. There is evidence suggesting that such gains will not really outweigh the pains.
Given India's demographic prospects and growth ambitions, we know that that urbanisation, development and skills enhancement are going to have explosive significance.
We also know that these prospects and ambitions are being addressed via public policy . But public policy must consider the efficiency principle as seriously as it likes to address the equity principle. Evidence from a range of sources points to the inefficiency of reservations from education to the labour markets. It isn't just about standards being lowered.
There is the issue of creamy layer cornering all available benefits, and then there is the question of whether the resulting ghettoisation is actually a desirable goal for a modernising nation. Does it merely reinforce caste categories instead of mitigating them?
Should the government not focus on addressing the inequalities in opportunity that arise out of a moribund education system, at primary, secondary and tertiary levels? The problem of differential access to education and skills cuts across caste barriers. Reforming that system is a lot harder than attempting populist gimmicks like job reservations. Overall, the proposal for caste-based reservation in the private sector appears extremely suspect.

This is atrocious, the author instead of demanding reservation according to population of 2001 census of 25% in private sector opposing the reservation on the basis of merit and efficiency and insulting the SC/STs students. It is proved on many occasions on many fields that the SC/STs are excelled, if opportunities are given despite that these people are saying the same thing with ulterior motive, tries to corrupt the mind of the people with intellectual dishonesty.
The meritorious and efficient who have denied reservation for the past 60 years not able to abolish untouchability ,poverty  and crimes against SC/STs but they are closing their eyes and ear on 100% reservation given to priest community in temple without insisting any merit and efficient except their caste as qualification.
How dare he can oppose the reservation in private sector when 25 % of SC/STs are languishing utter poverty with raising inflation,  Every one knows  the so called national growth(GDP) benefits only people like him It is not beneficial to SC/STs ,Knowing well that the Government and private sectors are not giving equal education to all but at the same time applying uniform standard while selecting for employment. The poor village students have to compete with rich convent students. Whether uniform yardstick is followed for differently educated students. Have ever these people thought of it, The so called Merit and efficient at whose cost, If he continuously write like this he should be teached a good lesson.

It is right time to consider for reservation in news media also as they are also enjoying so many concession from the Government such as newspaper materials at confessional rates,state,central and public sector undertaking are spending crores of rupees on  advertisements in the news media , social security schemes ,postal concession rates ,Foreign tour with high dignitaries and accessibility to the Government ,The SC/STs representation almost nil in this field. Because of this non representation some people are writing against the SC/STs blatantly with irresponsible manner and following untouchability by opposing  Government policy of reservation in private sectors.
